If you haven't filed in 13 years and have not heard from IRS you either are a wage earner who is giving up refunds or flying under the radar. If you are self employed in a cash business, failing to file tax returns will deprive you of social security benefits when you reach retirement age.
If you are intending to come in out of the cold, IRS has a written policy that is will only solicit six years of delinquent returns in most cases. If you file your 2002 through 2007 returns, you will be back in good graces with IRS.

If you are a W-2 employee, the IRS is VERY happy with you since you have foregone 10 years of tax refunds. Every year, the IRS totals up your reported income and determines if any extra tax is due. If they think that you owe, the WILL be in touch within 12 to 18 months of the end of the tax year. If they figure that they owe you, they'll wait quietly for you to file a tax return. If you don't claim any refund due within 3 years of the filing deadline, they get to KEEP your refund.
Prepare and file your returns for 2005 through 2007 first. Those are the only years still open for claiming a refund. Then run the numbers for 2001 through 2004. If you are due a refund for those years, get out your crying towel as the money is lost forever.
You can skip tax years 2000 and earlier as the IRS does not pursue tax debts over 6 years old where no return was filed. The courts have held that Failure to File is not tax evasion or fraud with no Statute of Limitations but simple negligence with a 6 year SOL.
If your calculations indicate that you actually owe, file the 2001 through 2007 returns ASAP to establish your liability and then set up a payment plan. The IRS won't even talk to you until you file the missing returns. |

If you live in America they have penalties.
But you can get a Tax Attorney to help you come clean it might cost you a few grand but, in the long run they will help you set up a payment plan, and reduce the amount you might owe the government, and if the government would owe you then it is easier to work things out.
From now on you might want to get an accountant to do your taxes, H&R block is really poplular but I actually got a lady who does taxes in several states and she does it for half the cost and has found errors they had made. |

Did you have enough income to be required to file for those years? Was it on a W-2 or a 1099, or was there no paperwork of either of those types?
If your income was on a W-2 and the IRS hasn't come after you by now, then you're probably OK and had refunds for those years or they would have contacted you. But you will have forfeited the refunds for most of those years by now.
If you were working on your own, with no reported paperwork, and never filed, you need to gather up your records for those years and get the returns filed, and make arrangements to pay what you owe. There will be penalties and interest for late filing.
The IRS can seize your assets, or prosecute you (with possible prison sentence) so it's in your interest to get this taken care of before they notice you.
Contact a CPA or Enrolled Agent, and have them help you through the cleanup process. |

Bostonia's answer is good except that you only need to go back to 2002. 2001 is no longer required.
It's likely the IRS would have filed a "substitute for return" by now if the reported income documents suggest that you would have a tax liability. In fact, if you've moved around a lot it's quite possible that they have.
I suggest calling the IRS to see the current status of your account. They will advise you of any balances and which returns you are required to file. |
