Yes, you can file your taxes with your last paystub. Basically what you need to do is to create a substitute w-2 using that pay stub. Yes, it will be slightly inaccurate, but the IRS will accept it -- and it's better than not filing at all, no matter how you slice it....

Contact the IRS.

According to the IRS:

If you do not receive the missing or corrected form W2 by February 15th from your employer/payer, you may call the IRS at 1-800-829-1040 for assistance. You must provide your name, address (including zip code), phone number, Social Security Number, dates of employment, your employer/payer's name, address (including zip code), and phone number. The IRS will contact the employer/payer for you and request the missing form. IRS will also send you a Form 4852 (PDF), Substitute for Form W-2 or Form 1099-R.

If you do not receive the missing form in sufficient time to file your tax return timely, you may use the Form 4852. If you receive the missing or corrected Form W-2 or Form 1099 after you file your return and a correction is needed, use Form 1040X (PDF), Amended U.S. Individual Income Tax Return. Refer to Topic 308, Amended Returns, for additional information.

I don't understand why there isn't some place to contact former employers. Who did the forms for them? You must attach a W2. I guess you better call the IRS. Remember that anything the IRS says, they cannot be held accountable for it but they are all you have. You can go online at www.irs.gov and see if you can find that answer on your own too.

Yes, you can file without the W-2 if you have a pay stub from the end of the year and can closely approximate your earned income and the taxes withheld for the year. You can also contact the IRS if you cannot reach your employer to get a W-2. See this link for more information:

You have 2 options, Use your last check stub just the way you thought.. or contact IRS @ 1800-829-1040 and you will hear the option of what to do when you haven't received a W2 from your Employer. See what help IRS will provide to you.

Complete IRS Form 4852 and attach it to your tax return.
Use your pay stubbs to complete it.

That should keep you safe with the IRS.

If you call IRS, they will tell you just what I have stated. So, save yourself the trouble.

Not accurately. Call the IRS and ask them what to do because what the company did was illegal. They can't legally withold it from you.

If you worked for them and they withheld taxes from your paycheck, they already have your SSN. I'm not clear on why you don't trust them with it. It seems like the simple solution is to simply fax them what they need so they can send you the W2, and be done with it.

Anyway, as a previous commenter said: the company is required by law to provide you with your W2. So be persistent. Is this a large company, with an accounting department? If so, talk to someone in that department directly, preferably the department head. If it's a small company, talk directly to the president of the company.
