I heard that there is no law that states that we have to pay a federal income tax. Is this true?
I was watching a video that was talking about 9/11 and at one point there was a couple of former IRS workers that said that there is no law that says that we have to pay an income tax. They said that after asking about this there boss' pretty much tried to "hush" them. After quitting the IRS they said they have not filed there taxes since. I am wanting to know the truth of this.

No, it is not true. There are laws concerning income taxes and they are codified as Title 26 of the U.S. Code. You can read it at http://www.law.cornell.edu/uscode/html/uscode26/usc_sup_01_26.html or at http://www.access.gpo.gov/uscode/title26/title26.html
The sections that apply to most people are sections 1, 61, 62, 63, 3402, 6011 and 6012.

Sherry Peel Jackson was probably one of the people you saw in the film. In October 2007, she was convicted of four counts of willful failure to file tax returns. On Feb. 14, 2008, she was sentenced to four years in prison. Also, she still has to pay her taxes and penalties.

· THINGS I DIDN'T KNOW UNTIL I SAW THEM ON THE INTERNET:

Nobody ever really landed on the moon - it was a giant hoax. What you saw on TV was filmed in Utah.

Elvis is still alive, and performing marriage ceremonies in Las Vegas.

It is unconstitutional for the government to tax your wages (income tax), the 16th amendment was never ratified, and most of what we think of as income isn't really income anyway.

Excuse me now....I just won 2 million pounds in the online UK lottery when my email was randomly selected, and I have to go answer the email.....

;-}

well, you can be jailed for failure to declare income or to pay enough - it is called tax evasion and is what Al Capone was jailed for, not for any of his more violent crimes.

Tax protester statutory arguments

it gives various arguments about your question - but you can still be thrown in jail if you don't pay.

The IRS has a wonderful section on its website called The Truth About Frivolous Tax Arguents. See http://www.irs.gov/taxpros/article/0,,id=159932,00.html. It debunks, in great detail, all of the tax protester arguments. As others have noted, there are many people who are or have been in jail for trying this nonsense. Does everyone get caught? Of course not. But eventually, the chances are good that someone trying this will be.

16th Amendment
In 1895, in the Supreme Court case of Pollock v Farmer's Loan and Trust (157 U.S. 429), the Court disallowed a federal tax on income from real property. The tax was designed to be an indirect tax, which would mean that states need not contribute portions of a whole relative to its census figures. The Court, however, ruled that the tax was a direct tax and subject to apportionment. This was the last in a series of conflicting court decisions dating back to the Civil War. Between 1895 and 1909, when the amendment was passed by Congress, the Court began to back down on its position, as it became clear not only to accountants but to everyone that the solvency of the nation was in jeopardy. In a series of cases, the definition of "direct tax" was modified, bent, twisted, and coaxed to allow more taxation efforts that approached an income tax.

Finally, with the ratification of the 16th Amendment, any doubt was removed. The text of the Amendment makes it clear that though the categories of direct and indirect taxation still exist, any determination that income tax is a direct tax will be irrelevant, because taxes on incomes, from salary or from real estate, are explicitly to be treated as indirect. The Congress passed the Amendment on July 12, 1909, and it was ratified on February 3, 1913 (1,302 days).

AMENDMENT XVI
Passed by Congress July 2, 1909. Ratified February 3, 1913.

Note: Article I, section 9, of the Constitution was modified by amendment 16.

The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.

I think the latest victim of idiots who preach that the income tax is illegal is Wesly Snipes. He is going to jail for three years and now owes the U.S. Government millions of dollars.

anotherbsdparent
It is not true. People have tried to pull this one off in court and have lost, to their cost.

Ask Wesley Snipes. He was just sentenced to three years in prison. He was advised that there was no law that required him to pay taxes and so he didn't. If they can get him, they can get you.
