For your 2008 taxes, you can get a divorce.

For your 2007 taxes, you would have to get the marriage annulled, since it is too late to get a divorce in 2007.

you don't file your 2008 taxes until 2009. Now is filing season for 2007 - you were married in 2007, you can file married - joint or separate

Sure, get divorced before the end of the year and when you file your 2008 return in 2009 you will file as Single.

However for your 2007 taxes now being prepared you MUST file as Married Filing Jointly or Married Filing Separately. You don't have a choice in the matter as your marital status on 12.31 determines your filing status for the entire year.

You are considered married filing jointly. I there are certain circumstances that makes you want to fie seperate. Such as he or she owes back taxes, he or she owes back child support, he or she owes back federal student loans, and you are afraid that if you have a refund coming then it would be snatched up by the IRS...there are ways around that. You can file an injured or innocent spouse form, which means that you would still get back your portion of any of the refund that you would normally be entitled to. It also depends on if you live in a community property state. But normally it's better to file jointly. There used to be an unequal exemption amount to single/married, but that gap has closed depending on age. The exemption amount for being married is just double as what it would be if you were single.

You are married, and you and your spouse are filing separate tax returns. Married filing separately (MFS) taxpayers have the least beneficial tax treatment. But MFS status is the one way to achieve separate tax liabilities. Married taxpayers should carefully consider whether filing joint or separate returns will be most beneficial for their unique tax situation.
Note about Married Filing Separately: There are very good reasons for a husband and wife to file their tax returns separately. However, filing a separate return may require just as much cooperation between the husband and wife as filing jointly. Some good reasons for filing separately include:

When you are filing separately, you must still cooperate and share tax information. If you both have children, you must coordinate who gets to claim the children as dependents. Finally, you must know if your spouse is itemizing deductions or taking the standard deduction. People who choose to file as Married Filing Separately do not qualify for several tax benefits and tax credits. It may be to your advantage to file jointly, or to get divorced so you can file as a single person.

If you were married on December 31, you were married for all of 2007 and should file as such, be it jointly with your spouse or separately, unless, of course, you get the marriage annulled.

by irs law, there is not obligation to filling joint or separate, you can live under same roof and file married separate or joint return, what ever is better from financial point of view, like spouse has huge income, or some kind or business. Or you can file head of household if you can claim your self one.
