No, he cannot. I am a tax preparer, and we run into this question all the time. He cannot file as Head of Household on his return, but he can still claim you as a dependent as long as you have less than $3200 in income for the year.

Just a quick bit of education: The Head of Household filing status can be used by an adult who is supporting a relative. That relative can be a child, a parent, or even an aunt or sister. There are several other variables, so in case you're interested, I have given the IRS website showing the Head of Household rules.

That is a tough one, you should call the IRS and ask them. I think you have to be married or related. But, you can claim any relative that has no income as a dependent . No age limit. It is either or. They have to either have no income or be under a certain age and even then, if they work and make over the allowable amount you can not claim them. If there is an older adult that has no SS benefits or income, they can be claimed on their relatives taxes, such as a child or neice, nephew whatever as long as that person can prove they support them.
