Your bf can claim you if

1. You lived with him for 12 months in 2008
2. You had income subject to tax of less than $3,500
3. Your bf provided over half of your support.

In order for your bf to claim the children:

4. You must not be required to file a tax return. If your only income is wages, this means you have to earn less than $8,950.
5. If you file a tax return, you do not claim your children or waive the exemption to the other parent, and you file only to get a refund of tax withheld (so no credits).
6. Each child that is claimed must satisfy 1., 2., 3. above.

If your bf qualifies to claim a child, then he only gets the $3,500 exemption. He does not get the head of household filing status, the child tax credit, or the earned income credit based on the children.

If these are not his children:

1. did you live with him from 1/1 to 12/31?
2. did you make less than $3500?
3. did you provide more than half of the support for each of you?

If yes to all of the above, he can claim the 3 of you as qualifying relatives. That's $10,500 more in exemptions and if that reduces his tax, he gets more of a refund.

since the children are not his biologically, he CANNOT use them to claim head of household filing status, child tax credit or EIC.

Did you work? If you made over $3500 gross income for the year, no he can't claim either you or your children. If you didn't have $3500 or more income, and you and the kids lived with him ALL year, and he provided over half of your support, he might be able to claim you, but not get EIC or child tax credits for the kids, and couldn't file as head of household.

If your relationship relationship is illegal under state or local law - there are still a number of states, and some local areas, that have laws against cohabitation by unmarried adults - if the law is still on the books where you live, even if it isn't enforced any more, he can't claim you but might still be able to claim the kids.

vb is right. But make sure those three things are OK, such your total earnings of less than $3500 (NOT $35,000) -- in other words, you are not working. AND if the childrens' father pays anything in child support, this might not apply.

No he cannot claim you or your kids... if the kids are his then he can claim them but otherwise no.

no he cant claim you or the kids unless the kids are his. he can claim the kids. but not you.

If you're not married to him, then you cannot file jointly nor can he claim u and your kids. If you were like a full time college student living w/ someone, then thats when you're a dependent.
