"I did it wrong and cheated, so should you", isn't good tax advice.

There's not enough info here to determine the correct answer.

"I only made a few thousand..." Does that mean you earned MORE or LESS than exactly $3300?

If you made more, you aren't going to be his spouse or his dependent.

If you made less, you can only be his dependent IF you lived in the same household with him since Jan 1 2006.

Depending on your filing status, then the children's status will follow.

So everyone else who gave a definitive answer to this question DOESN'T HAVE ENOUGH FACTS to answer it.

i think you have to be marry in order for him to claim you and your daughter

cuteprincessbaby
As a dependent in general, no you and you're daughter can not be claimed and unless the child is his, he can not claim your daughter either. You're fiancee must meet the relationship test in order to claim a dependent and one of those tests says that the child must be a blood related relative, a stepchild (you have to be married to claim her as a step-child), or a foster or legally adopted child.

yes he can claim your kids! My son claims his fiancee's 2 children that live in his home and he support them and their mom.
taxes can be confusing and arguemenative.
I would suggest going to a tax company acountant and getting this information on how to do it. I know that my son gets a big kick back from both of these children which helps him alot.

Only if he provided more than 50% of your support AND you lived in his household for the ENTIRE year.

Actually, he can't because you and your child aren't related to him. The relationship test is what keeps him from being able to do it. If you were married, he could.

unan1m0us
he might be qualified as head of household
