no you paid for more then 50% of the babys care so you get to claim him, no questions asked If the baby lived with you for 7 your good to go. The money is all fo yours head of house hold and 1 dep pluss If you earned under 35,241 bucks you can also get earned income credit make sure you do that as well. |

Check on your state's law. In some states, you and your ex-boyfriend would become common law spouses by filing a joint return and therefore legally married, and would need to get a divorce. You really need to talk to a lawyer. |

You are in a bit of legal mess. You can't file joint return if you are not married. My first suggestion is to seek professional help but the cost of that could offset the return you got.
The next thing to consider is to file an admended return for last year and get it correct. You then, it sounds like, would get the whole return using the proper submission. Then he can't make any claim for the funds.
But the reality is that he can't make a claim on you anyway, since if he reports you, he is also reporting himself, true?
This is unofficial advice, but I'd call his bluff. Tell him to call them. Worst case scenario is they audit you, redo your forms and based on the result you may get more or less back...which is the right thing to do anyway (see first suggestion). If you owe some extra it shouldn't be that big of a difference in the check size...and you will pay penalties which are sometimes quite a chunk of your refund.
In any situation, it will cost you. So call his bluff and see if he forces your hand to choose one of the options I've offered. But he would be in the same boat.

Who?! What?! Why?! You guys filed joint and you were not married?! That is not the right answer there! Putting that aside, if you have no divorce decree, the person who the child lived with most of the year (6+ months) can claim him. If it was equal, then its the person who makes the most money. Dont worry, if he tries to claim him the IRS will use the tie breaker rule on their own. If you are in the right dont worry |

This guys has some balls! He didn't support his child . I doubt it very much that he can claim him. Check with someone that know how to do it or check IRS.gov may be you can find better info. there. Watch his steps he might try to go behind your back and file his taxes and claim his son.

First of all, you need to read Publication 17 by going to www.irs.gov, there are stipulations for filing joint and a boyfriend is not a spouse. Second, if he reports you to the IRS, the IRS will focus on whether or not you are entitled to claim the child in which; if the child lived with you and you provided for him/her, you are more than likely entitled to claim him tax lawfully. If boyfriend is upset because he did not get a piece of the "pie" this would not be an IRS matter, but Civil matter. Now, do you have to file with him? Darling, you all are not married. Sounds like you could file Head of Household though. Call IRS at 1-800-829-1040 and ask all the questions needed. |
