when you hired her you should have had her filled out a W-4 with holding form and you should have sent her a W-2 form for the taxes with held from her pay checks if t you paid her by check that is the only way she needs to give you her #SS take it up with the IRS |

You should not have hired her without it. You are supposed to get the social security number of an employee when he or she starts work, not wait until you need it for tax forms. |

If she works in your home, you've got bigger problems--you as employer were supposed to give her a W-2 and withhold taxes and the forms are due. (If it's a W-2, you give her a W-4.)
If you drop your child off with her, you don't give her a W-2, but you give a W-10 (request for day care provider's information) and tell her that if she doesn't return it, you will list her name and address on the form 2441 with the explanation that she refused to give you the SSN.
To the other poster, W-10 *is* the correct form. |

when you file put as much info as you have on her you will get your tax break for child care expenses and she will have to pay taxes it sounds like she is trying to get out of paying them |

if this is a part time gig... then she doesnt have to give it to you.. yes, of course everyone is supposed to claim all income. but how many people actually do?? think about it... how many waitresses ONLY claim 10% of their tips... PLENTY!! its the same thing... if she doesn't want to give it to you... so that you can say 'she charged $12 an hour for 40 hrs a week..' and she really only charged $7 hr and worked less than 20 hrs a week.. We all know several people take advantage of babysitters and their so-called income..
i feel like if you didn't get that infor... before she started -- then you were pretty much agreeing with her that you would not file taxes based on her childcare. if a 17 yr old. babysits and files taxes... do you really think that she is going to claim her babysitting money on there as well.. i hate to burst your bubble.. but she isn't. and if she isn't licensed then she definitely doesn't have to give you her SS#. |

she's avoiding having to pay taxes which is why she won't give it to you. Either that or she doesn't know what you need it for. Most people won't give out their ssn if they aren't absolutely sure that you're not going to use it. |

Tell her she can apply for a federal identification number which will serve for tax purposes and you can use that instead of her social security number. If she is trying to avoid paying income tax then she is probably unlicensed and unregulated and not a good place for your children.
You have no guarantee that she or those who work with her have been screened for criminal activity and she may not have insurance to cover anything that may happen in the course of watching the children.
I would take this very seriously if I were you and go to a provider who has the credentials to do this important work. |
