Ups | I need my fathers tax return, because he is going to claim me as dependent. He won't give it to me though.? |
I am about to start graduate school.
My father provided a little more than 50% of my support last year, and because of that he is going to claim me as a dependent.
Thing is, I am filing for in state residency and because of that, and the fact that he is claiming me as dependent, I have to have his tax return.
He won't give me a copy to send the school.
I am likely going to have to pay out of state tuition because he wont give me a copy. What can I do? Should I just say I was independent? They say if he claims me as dependent, they have to have a copy of his tax return proving that. |

if he will not let you have a copy, apparently that is all there is to it and as such your only alternative is to file your own tax return on your own
when the duplicate SS# shows up at IRS, one or the other of you have to prove the dependency(or lack of it)
you mention graduate school? that means you are more than 24? as such you are no longer his dependent
you also mention he provided a little more than 50% of your support, you need to be more specific about that, support includes your % of the rent(mortgage) property taxes, utilities, repairs, insurance, phone, food, clothing, medical, entertainment and transportation--living at home at least 6 months and this includes being away at college |

If you are a dependent of a parent and that parent is not a resident, then you are probably not a resident either.
You cannot get the tax return from your father, he is not required to provide it. |

Caveat Emptor
 |
You can't force him to give you his return. But review IRS Publication 501 to see if he is really entitled to claim you as a dependent. There is no "choice" or "option" in deciding if someone is a valid tax dependent. |
