I never filed 1999 tax return and just recieved a bill. Can I file my 99 return still?
I never filed my tas return in 1999. I recently recieved a letter from the IRS that I owe money from that year. I recently did my 99 return and relized I was owed money. Is there a time limit on how long you wait to file your return. I am not looking for the money I am owed from 99 but I dont want to have to pay either.

You never filed, but IRS sent you notices give you the opportunity to file, (IRS would have sent the notices 2-3 years after the actual due date of the return) you chose to ignore IRS and IRS had no other option than to file the return for you. When IRS files for you they would of filed you as single, standard deduction, and 1 exemption. You chose to ignore IRS because you were due a refund, but when IRS files for you they do not know how many exemption or any other deduction you may have been able to claim. IRS has been sending you notices that you owe and explained why, but again you chose to ignore until now. You can still file the return so you can claim your deduction, correct the filing status etc. But more than likely you will still owe late filing penalties, and much more.
You will not get a refund of course you lost that 3 years after the original filing date.

You can file a tax return for any year in which you did not already file. If you owe the IRS money, you will have to pay with interest and maybe penalties. You can sometimes argue your way out of paying the penalties, but never the interest. If it turns out the IRS owes you, they will only pay you if you file the return within 3 years after it is due. So, right now, you can file AND RECEIVE A REFUND for 2005, 2006, and 2007, but not 2004 and earlier.

I've helped a client with the exact same situation you are in. He didn't file an old return and the IRS claimes he owed money. When we did his return, it turns out the IRS owed him. The IRS assumed things like a standard deduction and no dependents when they thought he owed them. But, we put together a correct tax return showing that the IRS is the one that owes. They didn't pay the refund, but they did stop sending letters saying my client owed money.

Don't delay! If you wait too long, they may insist you pay them even if you can show them they are wrong.

Well if you were due a refund, you won't get it

But, if IRS is billing you, file the return and pay what you owe, which may not be what they are claiming. . .and there are penalties and interest. . . so it's to your advantage to file, although you won't get the refund

YES you can file the 1999 tax return and avoid paying the amount that the IRS is now demanding. However you will not receive a refund if you would have been due one back in 1999.

If you can prove that you didn't owe as much as the return they filed for you, then you won't have to pay what they said you'd owe. But it's WAY too late to get your refund.

Since it was so long ago, you will have to work that out with the IRS. You can no longer claim the refund, but you shouldn't have to pay if you were owed a refund. You will have to present proof to the IRS of all of your deductions.

Write "SFR Protest" on the top of the return you have prepared and mail it to the address on the IRS bill you received. As long as your return passes the smell test, IRS will adjust its assessment. The statute of limitations for claiming a refund has past, but that is still better than having a bill to pay.

If the IRS says you owe money, you probably owe money. I wouldn't try to fight it by using your 99 return that you just completed 3 days ago.

Pay it ASAP or they'll add more penalties and interest to it.
