As a parent who was a child that never received support from my own dad, I can assure you that your children will never want any part of you in the future. You need to get yourself straight with support and not be such a jerk. |

IRS is not taking your tax return. IRS is taking your Tax REFUND, it will be offset. and by the way if you qualify for the stimulus it too will be offset. Aren't you glad your child(ren) will finally get something from you. |

Last year, I was certified by a major tax firm to do tax prep and one of the things that I learned was that child support can not be used as income on the Federal tax filings; HOWEVER, as far as the state tax goes, it depends on the state. Your ex also has the right to pull you back into court and get an order of support and have your wages garnished up to 25% <that you will have NO say on and this comes straight off the top of your paycheck even before you see anything.>
I am going to spare you my personal viewpoint on this issue of your owing back child support and try to remain neutral (no matter how difficult I am finding it to do so, as it DOES TAKE TWO TO MAKE A BABY! and if you question the paternity of the child, you can hire an attorney, if you don't already have one, go to court and try to seek a paternal DNA testing to establish who the baby's father is.)

Most likely. The rule is that you have to be at least $500 behind before they are ALLOWED to take your federal refund, & you definately passed that mark. However, the IRS does not do anything on it's own, the cs office that holds your case MUST tell the IRS to intercept. If the cs office does not submit your name/social to the IRS, the IRS will do nothing. So if the cs agency did there job, you won't get your refund, or at least not 3,490 of it. If they missed you for some reason then the IRS won't do a thing. |

I think it will depend on whether or not YOU have been filed on by the state attorney general.... If they dont take you return, use it to PAY YOUR child's support. Pay it through the proper channels so you will be credited properly. |
