The W-2 was sent to the IRS. You can get a copy of that document from them. In fact, they have likely enclosed a copy of it when they contacted you for the tax owed.

Anytime after that W-2 was sent to the IRS, you could have asked for it and prepared your taxes.

The IRS may not have figured the tax you owe in the most advantageous way. You should take your IRS correspondence and your 2006 tax return, if you filed a return, to a tax preparer. The preparer will figure out if the amount in the letter is correct or not. If it is correct, you have to pay. If the amount can be reduced, the preparer will prepare what needs to be mailed into the IRS.

This is not a matter that requires an attorney. The fact that you did not receive a W-2 does nothing to reduce the tax or penalty that you owe.

Did you file a return at all for 2006? If not, then the letter you received is likely a notice that the IRS is going to file a substitute return based on the income information reported to them. This is done at the single or married filing single rate with only the standard deduction given. If you have different filing status, dependents to claim, or itemized deductions, you might not owe at all.

If you did file a return, this letter is telling you that not all income was reported on the return. If that's the case, then you owe the money because you didn't have sufficient withholding.

Ms. Angel..
When you didn't receive your W2 for that year by Feb 15, you were to contact IRS so IRS could contact the employer. So you not receiving your w2 from your employer is no excuse.
How is it that IRS is making you pay $2K if you didn't file your return, or did you file?
If you didn't file and you received a letter number 2566C from the IRS, the letter is giving you 30 days to file your own before IRS files for you.
Please update your question, letting me know if you filed the return or not.......

It sounds like IRS got its copy; it doesn't just dream things up. Contact IRS for the information and go from there.

If you just didn't report the income, you do have a problem since you should have dealt with the issue back when it occurred. If the company deducted income tax from your pay but didn't report it to the IRS, then if you have any proof, like even some of the pay stubs, you might be able to convince the IRS that you don't owe as much as they think you do.

BeachBum
You are required to report all your income even if you recieve a W-2 or not.

You need to contact a good tax lawyer who can work with the IRS.

Consult a tax ATTORNEY. Couple hundred dollars, and you are informed on what action you can take. Your former employer has a tax identification number that can be found anywhere in the US.

Hope this helps..

Consult a good CPA and let him present your case. It does not seem to be your fault, so at least it will help to keep your records straight.
