You paid her, if she didn't claim the money for an income and they prove she was paid, that is her problem. But a question for you, why pay this way, don't you want to claim it on your taxes or do you like paying more taxes?

No, it's her problem not yours, but you gave up getting a child care credit.

If she provided daycare at your house, and if you paid her more than a certain amount (the amount is $1,600 for 2008, was lower in previous years), then she was most likely a "household employee." That means you were required to withhold social security, pay unemployment taxes, and file a form W2, amongst other things.

That being said, if is possible that if they catch her missing income they will most likely increase her tax liability without coming to you at all.

Now, if she provided daycare at her own location, then the ball is completely in her court. Any reporting requirements would have been her responsibility.

No, that's on her. She's the one who recieved the money and didn't pay taxes on it.

What do you mean you paid them under the table? As a customer you pay the business, and it's the business' responsibility to pay taxes on that money. I'm not a CPA or anything, but this seems like it's all her problem.

Maybe I'm misunderstanding the question, and somehow the daycare is your client/customer . . . is that the case?

What probably happened, is that you did what you were suppose to do and that was deduct daycare expenses on your taxes. There probably were other clients of hers that also deducted their daycare expenses on their taxes. So the daycare filed her taxes not writing off exactly what she received and believing you were not going to claim what you paid for daycare on your taxes, which is your right. You are not in trouble, she is.

You don't pay day care under the table, you are not her employee and she is not yours. If you have receipts, keep them.

What do you mean? You can't pay a provider under the table, you can only pay someone under the table if they are your employee...someone who's not providing you with a product, in this case a service. She's responsible for taking care of her taxes. If she didn't report the amount she collected from you, that's her problem. You wouldn't get audited.

It's possible. It depends on how your daycare is going to classify the income that they made. I would get in touch with a tax specialist and find out what you need in case you must protect yourself now and in the future. Paying them under the table is only doing them a favor, not you. Good luck!
