well if your only paying child support then you are not the main provider for that child the person who has custody of the child is the main provider so they get to claim the child on their taxes unless you have an agreement in your divorce that you are paying soo much child support that you actually get to qualify to claim the child on your taxes this is not a common thing though

Usually not. Your child support is only a fraction of what it takes to take care of a child. The custodial parent is one one that gets the deduction.

Absent a divorce decree stating that you get the exemption, it goes to the custodial parent unless they sign it over to you.

Sorry, but there are only two ways for a non-custodial parent to be able to claim their child as a dependent:

Have a valid court order that says you can claim the child, or

Have permission in writing from the custodial parent to claim the child instead of the custodial parent claiming the exemption.

Jss
Normally, if there is no court order, then the parent who has the custody of the child can claim the child. Child support does not matter.

That should have been addressed in your divorce papers. If it is not, then usually the primary custodial parent has the tax exemption for the child. Ask your lawyer, if there is something you can do to claim it, he can tell you.

You will have to negotiate with your ex.

It depends on your divorce agreement

wartz
Probably not. The general rule, stated coldly, is that the parent who has possession of the body gets the exemption. If you can get a signed release, IRS Form 8332, you can claim the child.
