I received my husband and I's stimulus check and cashed it at the bank, Do i have to split it with him?
My husband and I are seperated...i received the stimulus check yesterday, Both of our names were on the check, I took it down to the bank, Only signed my name and they cashed it for me. My husband and I do not live together or anything, we are getting our marriage dissolved at the end of july (this month). Can I get into trouble for not giving him any money? Or get into trouble for anything else....Just wasnt sure, I didnt do any "forgury" I only signed my name on the back, but him name was on front of the check too. We only got back $606.00, and we filled jointly. He has taken so much from me already and just left me with all the bills and stuff.....Will someone Please help me! Can I get into trouble for cashing a check with my name on it, plus my "still" husbands name on it and not give him anything? Legally yes you have to give him 1/2 He could go after you for it when you go to court

the bank should have never cashed that without his signature. yes you can get into trouble for cashing it and not giving it to him

The bank should NOT have cashed it without his signature too. You'd be ahead in the long run to just give him half the money (as a check, so you have proof) since legally you weren't allowed to cash it without his signature, and yes you could get into trouble for that.

Since his name is on it then YES, it is HIS money too. If he left you with all of the bills I do not think that it is a problem if you keep it. The lawyer you are working with should understand but consult them BEFORE you make a decision!

If it was issued to both of you and you "cashed it" without his permission (i.e. his name is jointly on the check), you may have committed fraud. The money legally belongs to both of you. Both of you should have endorsed the check or it should be deposited into a joint account.

While it is not likely, The IRS could come after you for cashing a check by yourself that was made out to you and your soon to be Ex. If your Ex contacts the IRS the IRS will start an investigation.
