I recently got divorced in September of this year after a 25 year marriage. Can I file taxes as single?
I got divorced after 25 years this September. When I do my taxes this January can I file single? I want to finally do the 1040 EZ and maybe get a return, since it seems like I have always owed money when I was married.....I will be single at the time of filing my taxes in January so I think I should be able to file as single. Just to clarify one point. Your divorce must be final by 12/31/07 to file as Single. If it isn't, then your two choices are Married Filing Joint or Married Filling Separate.

Amazing how many wrong answers you've gotten to what's really a very simple tax question. The one from ahottie who says "CPA" is particularly disturbing!

If you are divorced as of the last day of the year, then you may file your return as single. If you have a dependent child living with you, you might be able to file as head of household, but couldn't use 1040EZ then, would have to use 1040A or 1040.

Filing a different version of form 1040 won't make any difference in what tax you owe or what refund you get. But filing as single, showing only your own income and withholding, could make a difference from when you filed as married.

If you are divorced as of 12/31/2007, you file your 2007 return as Single.

"ahottie4u" is neither a CPA nor did she get her answer from a CPA. PERIOD.

Your marital status on 12/31 determines your filing status for the entire year. In your case, that would be Single assuming that your divorce is final. If you have a dependent child living in the home with you you may qualify for Head of Household status.

The number of amazingly wrong answers here never ceases to amaze me. But "ahottie4u" takes the cake by lying through her teeth on this one with her "CPA" claim.

Your marital status as of December 31 determines your filing status. If you are not married as of December 31, you cannot file as married.

Your possible filing statuses are single or head of household.

To avoid a surprise, have your taxes estimated now. Your standard deduction is lower than when you were married. You may owe more taxes than before, depending on what your income and withholding were when you filed a joint return.

You won't be able to file separately until the very next tax season. You won't be able to file 'married but separate' either.

If you are married for one or more days in a calender year, you have to file married by law
