I recently received a letter from the IRS that i owe them for a previous year. ?
However, I have already e-filed my return for the current year and my refund amount is way more than the amount they are saying I owe. I need to know whether or not this will hold up my current due refund or not. They also gave me 30 days to either accept or dispute the debt they are stating that I owe. So.....will the IRS keep my entire refund this year, withold the amount that I owe then refund me the difference, OR will they reject my return entirely?

I have no clue what to expect now. I am hoping they will at least still accept my current return and refund me what's left over after they take out the amount they claim I owe but I am not sure how the IRS handles that.

It is hard telling the timing from the information given.

What I think is happening from the timing, you just recently got assessed from a tax audit. If they gave you 30 days, after the 30 days is the soonest the IRS will try to collect. So your refund may be safe. This would either be a "notice and demand" letter, which is required before they start to collect, or a "final notice," which is required before they do a levy, either way they will give you 45 days to respond from the date on the letter (I know it says 30 days, but they allow for mailing time, unless they hand deliver it).

If it is a reminder letter, however, which look similar, they will take the money right away from the tax refund.

You were given 30 days to respond to the letter. if the letter is correct, call and confirm it. You might as well.

There is a chance they Proposed Assessment will not hit your account until after you get your refund. If that's the case, you need to turn around and send the money back in.

They will hold it for payment. You need to verify the info on the year you are being audited for. Did you have any W2's you forgot to include? You need to respond to the letter. If you want to fight it then do so and find out where the discrepancy lies. Did you have your taxes done somewhere like HR Block? If so go back to them before answering the IRS.

If you don't agree with what IRS says then find an enrolled agent or tax lawyer to dispute their figures.

They will keep the amount you now owe -- including both what you originally owed and all of the interest and penalties for not paying on time. If there is anything left, they will pay the rest of your refund.

Most likely they will take what you owe from the refund, and you'll get the difference. It might hold it up briefly, but this time of year, it should still go quickly. They aren't overloaded with returns yet. most don't start coming in for another 4 weeks.

IRS is not going to reject your 2008 return, IRS is not accepting e-filed returns until Jan 16.

the letter you received is giving you 30 days to accept or dispute, so have you reply with your answer yet, the amount IRS is going to assess for the previous year will not be assessed until after the 30 days, and the balance won't show on your account until at least 45-60 days.
You should receive your full refund for the 2008, did IRS enclose Form 9465 to request an installment agreement? If not and you aren't going to full pay the amount you will owe IRS with your refund then you could possible request and installment agreement. IRS charges a one time USER FEE of $105.00 for payments you mail in or a one time USER FEE of $52.00 for direct debit from your checking account. and interest and penalties continue to accrue while you have an installment agreement.
It is better to full pay the amount you owe than have an installment agreement.

Yes it will hold it up unless you go ahead and pay the amount you owe now. Otherwise your refund will be delayed. They will take out what you owe and send you the excess.

They won't reject your return (in fact it won't be transmitted until 1/16 which is the first day the IRS is accepting Efiles). And if you request an installment agreement for taxes due they will take your refund against any tax owed. Very often you owe less money than the notifcation states. First you must determine if you accept this debt or dispute it and respond to the notice accordingly. Check your local yellow pages for a tax attorney or EA Enrolled Agent - they can help you with this.

IRS will withhold the amount in dispute, until the matter is resolved. You will have it deducted from your refund. If you appeal the disputed item withing 30 days, and they agree, then you will get the balance.
