All the government asks is what was your marital status on December 31 for the tax year. If it was married (and there is no legal separation agreement), you generally have two choices - married filing joint and married filing separate.
There is an exception only if you want to get out of filing under one of those methods. They call it married, but unmarried for tax purposes. Since this is not what you are trying to do, you can legally file jointly with no worries.
Since the SSI is for a "disabled" child, it should not affect your benefits, but I am not 100% positive of this. Perhaps you already know the answer. If this is a concern for you, you should really check with your local SSA office. |

File married and seperated. That should help. I also have a son that is autistic my son is 9 and I also have three kids. You will get more money by filing together. |

I receive SSI for my son, who has autism too.
If you are legally married, then nothing should prevent you from filing together, especially if you both had jobs in 2007. |
