Yes you can. It doesn't have to be an actual day care center, just that she watches him so you can work.
You'll have to show her name, address and social security number on your tax return. She will have to claim the amount you paid her as income on her own tax return - she'd legally have to do that anyway whether you claimed the child care tax credit or not. |

You can claim the amount paid on the child care credit, but you must supply the IRS with the cousin's social security number and you cousin must claim the amount as income. |

Give her a form W-10. This form is to officially get her name/address and SSN so you can transfer this information to your form 2441 to get the child care credit.
Unofficially, this is a wakeup call to her that she's had taxable income for the year and MUST report it on her tax return.
If she refuses to give you her the SSN, you can still put the care down, but you have to read the 2441 instructions because the IRS will want a note explaining *why* you don't have the SSN.
Now, if she came to *your* house and babysat, there are other issues since you were supposed to be doing a W-2. |

You might, if you issue a 1099 to your cousin with her SSN and report it to the IRS.
If the amount is less than $500.00, no 1099 is issued, but don't try to claim a deduction. |
