I was claimed as a Dependent!?
Okay here's the deal, I lived with my ex and his mother from the beginning of 2006 till the end of 2007. (2 years) In 2006 She claimed me as a dependent because I was still attending school and did not have a major income.
In 2007 I was out of school working full time with my own benefits made well over 20,000 that year and not to mention, paid rent!! I paid $150 per month for the first half and $350 per month the second half! I paid all my personal bills (i.e. cell phone, medical, credit cards, college) the only thing is i occasionally ate there. There was no rental agreement drawn up but i have proof of my payments and income for the entire year!
All I wanted to know is, was it legal for her to claim me as a dependent? I honestly dont think so, and i'm unsure of what to do next....PLZ HELP!

Sorry i didnt clarify. I was 19 at the time of living with her, currently now i'm 20. She claimed me last year because technically i was a dependent so it was on her last years taxes. So should i call irs and report it? I mean is it legal for her to do that?

Her only chance was to claim you as a qualifying relative. From what you are stating, you are paying over 50% of your support, and she cannot claim you. You also were out of school, so that rules out full-time student.

Claim yourself. The IRS will compare and you will get your exemption. Your former mother-in-law will receive a bill from the IRS. They may also slap a fraud penalty on her. she deserves it. You've learned a bitter lesson but you did not lose your money this time {in the long run|. Change the social security number on your driver's license to a DMV number. Don't carry anything but what you have to carry that has your SS#: your SS card and may be you need a disability or medicare card. Do NOT give your social to any one nor allow any one to see it. DO NOT give your social out online, not even to your bank. Check your credit report. Keep as little in the bank as possible. You can expect the money to be drained. In every large city, rugrats sell social security numbers to illegal immigrants. There are a tremendous number of illegal, fraudulent SS numbers out there: may be as many as 40 million.

In 2006 you probalby were a dependent as long as your gross income was LESS than $3,300.

In 2007 you were NOT a dependent since your income was well in excess of the 2007 limit of $3,400.

Your age and student status are irrelevant since you can only be claimed as a dependent under the Qualifying Relative rule, not the Qualifying Child rule.

If she already filed her tax return claiming you you will not be able to e-file. You'll have to file a paper return by mail. The IRS will then contact both of you to sort out who is legally entitled to your personal exemption. You'll win that battle easily and she will have to pay back any extra taxes due that were refunded to her.

Grab a copy of IRS Pub 501 from the IRS website and have her read it. She can speed things up a bit if she files an amended return and dropping the dependency claim. If she does this by April 15th and pays back the extra tax there won't be any penalties or interest due.

BTW, the rent you paid is treated as cost-sharing by the IRS unless she is operating a rooming house. It has no tax consequences for either of you.

Based on the information you have provided, she should not have been able to claim you as a dependent. Furthermore, based on the fact that you paid her rent, she should have reported rental income on her taxes, which if she didn't, you should report her. So my advice - since your return will not be accepted electronically, you will have to file paper. Also enclose a letter explaining that she claimed you inappropriately and that she also collected rent. They should then audit her, and will get it straight, but it may take a little bit of time.

You need to file your tax return by mail not electronically. The IRS will determine who is entitled to the deduction. Sounds like you were entitled to deduct yourself. It will take a little longer but it will be resolved. If she get a refund in the meantime she will have to pay some back.

If you are not dependent, file your tax return and claim your own exemption.
Then both of you will receive letters from IRS. IRS will figure out who is right.

If you are planning on filing your own taxes then she can not claim you as a dependent. To avoid problems with the IRS I would have a serious talk with her. If she has already filed then you can figure out how much you would have gotten back and simply tell her she owes you the money or you will have to report her to the IRS for income tax fraud.

When you say X - do you mean husband or boyfriend....if you were not married - that family has NO rights to claim you as a dependent - you are not related at all....

She would've had to say that you were a full-time dependent & student - and if you make $20K that is likely a lie.
