You do NOT have to Pay Taxes on BackPay Disability Income. I have also filed over a year ago for my DD Benefits. I was hurt on the Job in 2004 and had to have two Total Knee Replacements, which I am Now in Physical Therapy for. Did you have to wait the Appointed Two year time to receive your Benefits like most individuals? I wish you luck with your Disability. It can be depressing at times, but things like YA has helped alot.

All Social Security benefits, whether from retirement, survivor, or disability, have the same tax rules.

If your income subject to tax from other sources, plus 1/2 of your Social Security benefits, is over $25,000 ($32,000 if married), then some of the Social Security benefits are going to be taxable.

However, there is a lump sum option which may lower or eliminate taxes owed when your Social Security benefits are lumped together for several years, as in your case. This is figured by looking back for the years you should have received benefits and figuring taxes as if you received those benefits over several years.

If taxes are due on your benefit, have a professional preparer compute the lump sum method for you and see if that is a benefit for you.

Or, you can study the example in the following Publication and figure the lump sum method for yourself (see page 11):

Check irs.gov for what you need to pay taxes on but disability isn't social security they are two different benefits.

If the back pay would have been taxable if you got it on time, it is taxable when you do get it.

I dont think so, i have been recieveing disability for 26 years and its all tax free i have been living tax free longer than i have paid taxes i went in marines at 18 got hurt at 20 spent 21st b day in hospital i am now 46 lol

No it's not tax-free and some people when on SS Disability have some withheld to pay their income tax.
"SSDI benefits may be taxable depending on your total family taxable income. For example, a person filing as an "individual" with a combined income between $25,000 and $34,000 would have to pay income taxes on 50% of the SSDI benefits. If the combined income is more than $34,000 then 85% of the SSDI benefit is taxable. You should consult with an experienced tax expert when your claim is approved to make certain that you plan for any tax liabilities."

Nope thats not taxable.. it'll be all straight up .. but also remember that you cant file taxes on your benefits either so if your not working you wont see a tax return... anyways i know for a fact the backpay is tax free.. its from uncle sam so theperson that answered before me is an idiot..

Yes you will have to pay taxes if you are referring to Social Security income backpay.
