No, someone who gets a 1099 is self-employed and isn't eligible for unemployment. They don't pay into unemployment either.


Caveat Emptor
If you were/are self-employed, you don't get unemployment. Makes no difference if the company you "worked for" (contracted with) went under.

No, as an owner (self-employed) even if you paid into the system for employees that you may have had, you, do not qualify for unemployment benefits.

For the most part, unemployment is similar to insurance. You can't collect if nobody paid the premiums. Some states will take pity on people who should have been considered as employees, but your case is weak since you fully admit that you worked for yourself and filed tax returns on that basis.

No. If you receive a 1099, then you are an independent contractor, not an employee, and cannot collect unemployment. Also, although you may pay in some taxes, you do not pay in the particular tax that is used for unemployment benefits (that tax is paid only by employers). You pay in other taxes which are used for other purposes.
