Where can I find on the web like a site that will show me how much I will get back with me making $20,000 this year and also with me claiming my 3 kids? Additional Details He files a 1099 on his employees and with me being his wife I was not sure how we can go about this. I think that he can file a 1099 on me and I will pay the taxes that I owe and then get a refund. It should be the same as if I were working and getting taxes taken out. You all need to chill out if you don't know the facts. |

Actually, you and they are in violation of tax laws if you are in the U.S. for not paying taxes. Filing to claim now that you want a refund may get you jail time but definitely may result in a fine and late fee. |

How is your husband's company organized? If it's a Sole Proprietorship, it's likely that what he gave you was just from the Owner's Draw account. That's not taxable income per se. The total income from the business is taxable though and will be reported on your joint tax return.
If it's a corporation, he should have withheld taxes on the money you were paid. If he didn't then he has some work to do to correct that error! The IRS will be looking for the payroll taxes on that income. The corp would issue you a W-2 for your wages (and his as well) and you'd use those W-2s to prepare your tax returns.
If he's operating a partnership and you're a general partner, it may be partner draw or something else such as wages.
Without a LOT more information, there's no possible way to answer your question.
Edit: Based upon your additional information, your husband needs to contact a tax pro NOW. Employees are NOT paid via Form 1099 and it only take one of them to start an IRS investigation by filing a form SS-8 asking for a formal determination.
Again, as his spouse, your situation is a bit different since this may be classified as "Owner's Draw" and may not be explicitly taxable in your case unless you're filing separate returns.
You need competent advice from a qualified tax pro immediately, either a CPA or EA who specializes in small business tax issues. There may be hell to pay with the IRS if they determine that he's been improperly classifying employees as Independent Contractors to avoid paying payroll taxes. It's a growing problem and the IRS has already started to crack down on this abusive process. |

Are you still married? Aren't you filing a joint return? Not sure what you mean by "me claiming my 3 kids" - where does your husband fit into all of this? If you file separately, even if you claim the kids you wouldn't be eligible for EIC, so since you haven't paid anything in, you'd owe, probably around $2826 for self employment tax. You would NOT get a refund filing separately. You're rigtht it's the same as if you were working for someone not related to you - you wouldn't get a refund then either, if nothing was taken out or paid in as an estimated payment, and you filed as married filing separately - you wouldn't be eligible for EIC.
If you file a joint return, you'll file the 1099 there, and will still owe that self employment tax. Income tax will be due on it also, but the total income tax for the two of you on a joint return would be less than the total you'd pay if you each file a separate return.
And by the way you don't give 1099's to employees. If the person meets the definition of an employee, then the employer is legally required to take out taxes, pay employer taxes, and give the employee a W-2, not a 1099. If he's doing 1099's with people who are really employees, then eventually he'll get caught up to, and it will be an expensive thing to straighten out.
Sounds like he, and you, should see a CPA or enrolled agent. Some of what needs to be done will depend on how his business is set up. And the rules for paying you, his spouse, could be different than the rules from paying other employees. |

If you were truly an independent contractor then he can issue you a 1099 and you pay the self employment taxes. If you were an employee he must treat you as one and pay the employment taxes he is legally responsible for. By not doing it you are both responsible for tax fraud. |

You need to contact the IRS and find out what to do about getting a W-2 form, or for reporting what you earned (whether or not you were paid in cash is irrelevant) and what you will owe.
You will owe taxes on any income you earned, no matter how you earned it or no matter what the employer did or did not do about reporting it. Missing forms like the W-2 can be obtained AFTER the fact. You are not in danger here of being prosecuted or jailed--this isn't something that is your fault. Don't be afraid to contact them for advice. You can call the 800 number in your area, and find out over the phone, or go to any local IRS office and ask questions without fear of reprisal.
If you got pay stubs at all, bring them with you. As a wage-earner with children, you should have enough deductions to cover any taxes you owe--you probably won't owe the government anything after it's all figured out. BUT YOU DEFINITELY need to contact them NOW about this.
You won't be jailed--I really don't think that was very good advice from a supposedly "top contributor." |
