E-FILE....If you e-file you DO NOT need to turn in a W2 and can just use the information that is on your last paystub from them. I wouldn't bother waiting for them to get it to you, just go ahead and file, I do it every year with my last paystub just so I don't have to wait. |

You should contact the employer who hasn't sent your W2. If you do not get it by filing time you can tell your preparer and use an estimate of your earnings. This IRS will contact the employer and demand that he send a copy of your W2 to them. |

No, you can't just "scrap it". The employers have until 1/31 to get W2s in the mail. It may take a week or so to arrive after that. |

Obviously you don't just scrap it. The employers' need to have the W-2s postmarked by January 31st (but the W-2 does not need to be in your hands by that date - common misconception).
You may find that you income does not warrant a tax return being filed but if you paid any federal income tax as part of your paycheck, then by not filing a return you would not be getting any refund back of those taxes paid.
Without knowing what state you are in I can't advise on that part.

W2 are not required to be delivered until the last day of january, so the company does have until then to get it to you. I wouldn't "just scrape it". since they government seems to recognize amounts of 3500 and above as significant numbers.
You might want to seek an attorney to see what you can do about it.

Did you contact the corporate office? If there isn't a corporate office, try calling your Attorney Generals office and ask them. Maybe even the Better Business Bureau. |

No you should not just scrap it. It's the employees responsibility to get your W-2 to you unless you changed addresses since that job.
If you don't get it in the next couple of days then call your state workforce commmision and they can direct you as to what action to take, it varies state to state. |
