I went to a local IRS tax shop and the lady stated I could claim both my little cousins since I am taking care of them 100% for over a year and I have looked on the irs.gov website and it does states a cousin is a dependent if they are with you for over a year. So why are they auditing me and I went to the local IRS in my area and they guy automatically said no, they didn't count so now I owe them in taxes, this is insane! cause they waited a whole year to send me a letter & now to make things work I'm not even working full time & I'm a student myself, Any suggestions on what I can do greatly appreciated! Additional Details Yea no kidding, they just added a late penalty fee of almost $1000, its insane. I'm actually considering getting a lawyer or finding some free advice on this. |

You need to fill form 2120 to support your claim
Use Form 2120 to:
Identify each other eligible person (see below) who paid over 10%
of the support of your qualifying relative whom you are claiming as a
dependent, and
Indicate that you have a signed statement from each other eligible
person waiving his or her right to claim that person as a dependent
An eligible person is someone who could have claimed a person
as a dependent except that he or she did not pay over half of that
person’s support
CLAIMING A QUALIFYING RELATIVE
Generally, to claim a person as a qualifying relative, you must pay
over half of that person’s support. However, even if you did not meet
this support test, you may be able to claim him or her as a
dependent if all five of the following apply.
1. You and one or more other eligible person(s) (see above)
together paid over half of that person’s support.
2. You paid over 10% of the support.
3. No one alone paid over half of that person’s support.
Try to see if this form works, submit it to IRS in relation to your filed taxes.
I know it's a hassle but it needs to be done.
In short, you need to have your cousin's parents sign the form waiving their right to claim their kids as a dependent.

You don't need a lawyer, but you do need a representative that can guide you in assembling the documentation that shows you did provide 100% of the support of your cousins. As an enrolled agent, I have a bias towards suggesting you find one of my counterparts in your area.
The best documentation would be a letter from your counsins' parents confirming you were the support provider and stating that they did not claim them. I suspect the parents did claim them which is what generated the audit. |

If your cousins actually lived with you for ALL of 2007 you can claim them as your dependents under the Qualifying Relative rule as long as they had less than $3,400 in gross income for the year and you paid more than half of their total support. There's no problem with that.
HOWEVER, you cannot file as Head of Household or claim the EIC, CTC or ACTC based upon a cousin. (Neices and nephews, yes, but cousins, no.) If you filed as HoH based upon them or claimed the EIC, CTC, and/or ACTC based upon them then the IRS is absolutely correct that you must pay back the extra refund money that you were not entitled to. |

The problem is, you didn't claim them just as dependents, but for HOH and EIC as well.
A qualifying relative is only good for the $3400 exemption and losing those exemptions wouldn't cost you $7000 in tax.
You managed to list them as qualifying children, which requires that they be your children or the children of your brother or sister--the children of your parent's brother or sister isn't close enough. (I'll bet that someone listed them as nieces and nephews on the return). If the children had been that close, you would have then been able to claim head of household status (higher standard deduction, lower tax bracket) as well as EIC (extra money). |

Did your cousins parents also claim them on their tax returns?
You need a tax professional to help you deal with this and determine if you are going to have to pay additional taxes or just paperwork. |
