My mother lives with me and the IRS is garnishing her wages because of mistakes on her last few income tax returns. I am having to pay all her bills now and I was already struggling to pay my own. Is there any assistance I can get with this in the state of Texas? Additional Details NO! NOT FRAUD! She took out a loan on her IRA and she didn't claim it correct at the end of the year when she did her taxes. Not everyone can afford a professional to do their taxes. And, no the IRS denied her payment installments and is taking everything except $45 a week. |

Why are you being forced to pay your mom's bills? If she has wages, then she is capable of paying her bills. The IRS can not take all of her money every paycheck. They have to leave you with some money to live on... I doubt the state will help you. If it's really bad, maybe you both should talk to a bankruptcy attorney. |

have your mother go to http://www.irs.gov and look up the tax payer advocate. Call them and have your mother explain the financial hardship being caused due to the garnishment. They should be able to help you work something out.
Next time, let her know she should report the penalty on the early distribiton on line 61 of her 1040 return. |

You can approach IRS to see if you can work out a plan to pay over years rather than taking the entire wage of your mom.
There is an appeal process.

they will NOT take everything but $45 to her. that would put her in dire straits, and is ridicules to boot. unless she had another income on which to live on.
If however it is putting her in an economic hardship you can ask for the amount to be lowered. If your asking for it use those words. Economic hardship. |

You might be able to claim your mother as a depended on your income tax return if you are providing over 50% of her support. NEVER, NEVER, NEVER disregard a letter you receive from the IRS, it only complicates matters and makes them worse. It doesn't sound right that your mother only has $45 left over from her paycheck unless it is very small in the first place. As a previous poster said contact the IRS and try to work out something. Generally they are reasonable if they see you are trying. |

Your mother wages would not have been garnished if she would of set up an installment agreement with the IRS. Have your mother call IRS at 1-800-829-7650 and ask if she can arrange to make payments, she will need to let them know what all bills she pays with her paycheck and they will work with her,
Ignoring the IRS is not a good idea. |
