IRS is Garnishing my bank account, what should I do?
I can't pay my unpaid taxes and now the bank is taking money out of my bank account. Can they do this? How Can I stop them?

Unfortunately, the IRS can do this and they will continue to do it until they have received all of the back taxes that you owe. There are ways out though and it can be released. You must prove to the IRS that by them placing this levy on your account it is creating financial hardship for you and you don't have enough money to live. There are federal rules and regulations for this as well as rules by state. The federal rule is this: Federal Wage Garnishment is 25% of disposable income (after-tax dollars) according to the Federal Wage Garnishment Law, Consumer Credit Protection Act's Title 3 (CCPA). States may vary but the CCPA states that if State Garnishment law differs from the CCPA then the lesser of the two must be observed.

also a good place to get a connection with a tax expert to get a garnishment released if you cannot do it yourself.

Good luck, the IRS can be difficult to deal with. They do settle though, so be persistent.

You will have been sent at least five bills including two by certified mail warning of the potential for enforced collection before your account gets to this stage. Now you are the subject of enforced collection action. To prevent future levies on your bank account or wages, you are going to have to either agree to make payments on your account or show that you don't have enough income to cover basic living expenses so can't pay anything more now.

The IRS can put levies on any account they can find. They can garnish your wages as well.

You never set up a payment plan or did and then defaulted. or you were asked for collection information and then failed to supply it....

The IRS does have the ability to garnish wages, I think that it would be a good idea to consult a tax lawyer about some options.

Sure they can do that - and you can't stop them unless you can convince them to set up a payment plan, and then you follow the payment plan exactly.

Once an IRS garnishment hits your bank account, you have 21 days to get it released. You did not mention when the garnishment started, so I am assuming recently. If you can prove that the IRS garnishment is going to cause you financial hardship, you can act to get the garnishment released. I recommend you contact either the IRS or get some professional help immediately to see what can be done to help you.

There is no such thing as you can't pay IRS, IRS would of worked with you with an installment agreement. You made no effort to work with the IRS so now they will garnish your bank account and they will contact your employer and garnish your wages. Call IRS at 1-800-829-7650 and make a payment offer.
IRS will work with you just call them and be honest, remember IRS knows everything about so don't try to lie to them.

yes they can..and wave bye bye .. i know a peron that put there sons name on the account just incase something happened to her and they need money . well needless to say he owed back taxes ..so the IRS to her money. just cause his name was on the account . even though he had never put one cent into the account . it was her retirement account . now she has a hard time getting by from month to month .. .. so .. say bye bye .. the IRS don't care .. you need to contact them about making payments on any more they say you owe.. this will keep them out of your account .

If you think IRS has erred, then contact the Taxpayer Advocate Office (via Google) and they will help you.

But if you messed up, then, well, take it like a man. You should have cooperated when you had the chance.

Wartz gives good advice above. You should consult a CPA or EA (both are authorized to represent you before the IRS) whose practice includes IRS collection matters. Depending on the circumstances, they may be able to help quickly.

Be very careful to avoid the "pennies on the dollar" mills.

close the accounts and hide the money in your mattress...this is what a lot of people do when they dont want the government to know how much money they have.

i know of a woman who buys gold coins so that if her house burns down she will still have the gold.....wow....this was great for her because she now has way more than what the bank would have paid her in interest. Gold has gone through the roof. she has more than doubled her money this way over the years....wish i did the same.

now the government does not know how much she has..or hs made in income ...but she is supposed to pay taxes on her profits.
but how will the government know or collect?
