 I have two part-time jobs which gross £4k pa - why do I pay tax?

IRS is requesting information examination on my return!?
I claimed to dependents one is one year old and one is six. My niece and nephew, and have contributed money throughout the year.. and they have not lived with me in my house but have supported them for the time being and was given permission from my sister to claim the 2 children since nobody was. Now the IRS wants to prove my relationship and proof of paying them, but i never kept up with money order receipts ( i know how stupid) ...but they kept stacking up. So what can i tell them if there's technically no written or physical proof that i gave money to them every month? I feel like im trapped! Did i overlook something, might i have to receive a penalty.. this wasn't intentional. I have 30 days to respond.

This situation is commonly examined by the IRS because it is usually fraudulent. The only way you could claim the children who do not live with you is if you provided over half of their support, which is unlikely, and from your information not provable.

First, the permission from your sister is meaningless, so forget it.

Second, since you are not a member of the children's household, the best benefit you could get from their dependency exemptions is a reduction of your income by $6,800. Even if you were allowed the dependency exemptions, you could not claim the Child Tax Credit or the Earned Income Credit.

So, since you cannot prove that you supported them, and you are in no way qualified to receive the Child Tax Credit or Earned Income Credit, respond to the letter by agreeing to remove the exemptions and make arrangements for paying back the tax refund you received by claiming them. If you do this quickly you will minimize further penalties and interest.

If their mother gave you permission to claim them as dependents, then have her write receipts to you for the money you gave her to support the children.

If you end up doing the same thing next year, remember to save your receipts!!

Sounds like you're going to lose the exemptions. Sorry. You might or might not have legally been able to claim them as qualifying relatives (not as qualifying children since they didn't live with you) but without any proof the IRS isn't going to just say well OK, we believe you.

Ooooh....you're effed. Maybe your sister could print out a bank statement with proof that she cashed the checks you gave her, or they were put into her account? I think if you can't prove it, you have to pay back some of the money, or pay a penalty or something??

1. Exactly who were these children living with? Your sister? Could you claim your sister as a dependent?

If you (or someone else) can't claim your sister as a dependent (which requires both that she made less than $3400 and that you provided more than half of her support), then SHE, as parent (or the non-custodial dad if the special rules apply) is the ONLY person who can claim these kids. If she can claim them, YOU can't.

Your sister could only "give permission" to the non-custodial dad (via form 8832) or some other family member who lived with her. Only if your sis is a dependent of someone else could the children be up for grabs...and even then priority is given to someone living with her.

2) Exactly how did you claim them on your tax return? Did you claim them as "qualifying relatives" (only good for $3400 exemption) or did you try to claim them as "qualifying children"? You weren't eligible for qualifying children since they didn't live with you. If you went so far as to claim HOH, child tax credit and EIC, you can be accused of fraud and banned from the EIC program for 10 years.

Even claiming them as qualifying relatives will be difficult since you admit you don't have proof you sent money, let alone have any calculations showing how this money was enough to cover more than half of their total support. Support is more than just their clothes--it's their share of housing, food, utilities where they live as well.

Wow, good luck. Thats gonna be tricky to prove that you "supported" them. I gave my 10 month old nephew alot of care last year as well(money etc) But I couldnt very well say that I was supporting him because his mother had legal custody. For them to be a dependent, they would of had to receive care form you at least half the year consistently. I think your going to lose on this situation.

Got Ya! The IRS is cracking down on things like this because so many people do it to get the Earned Income Credit.

But if you truly are supporting your relatives, then you have the right to claim them. It sounds like the father is not around to claim them?

If the kids lived with you for over half the year, then they would be Qualifying Children because they are your close relatives.

But, because the kids do not live with you, they are not Qualifying Children, so they have to meet the Qualifying Relatives test - which basically means that you have to prove that you provided over half of their support - this includes: clothing, education, medical, transportation and recreation, as well as their share of the food, housing, utilities and repair costs for where they live.

You look at how much it cost to keep the kids for one year and divide it by two. Then you look at other money your sister received - from other relatives, the father, work, welfare, savings etc... If what you provided was less than half, then the IRS will not allow you to claim them. If it is more than half, then there should be no problem, other than getting the supporting documentation.

I don't know - how do you prove the relationship? Get birth certificates for the four of you? You and your sister will show the same parent, and the kids will show her as their mother.

The idea of having your sister write receipts is a good idea. You may have to pull out your bank statements and her bank statements to show how much you both make and spend. If you don't have bank accounts and you paid the rent, did you get money orders made out to the landlord and you can you get some documentation from them?

You would have to send a LOT of money to meet the requirements for claiming these children. Just because no one else is claiming them doesn't mean you should.

Read through the requirements for claiming an exemption. You can find this at irs.gov. If you really feel you provided over 1/2 of the childrens support, you will need to estimate the money you sent and get a statement from the parent confirming that.

Shaky, shaky ground. You may be better off to just agree to paying what you owe.
