IRS question~ I know someone who has not filed taxes in yrs. Now she thinks IRS is "looking" for her
at mother's home! Agents apparently went looking for her~I don't think it was to chat. This is the issue- she was/is self employed, but subcontracted friends, kept no real records and did not make nearly what she appears to have made on paper. She had previously contacted IRS, I believe two yrs or so ago but got cold feet about going into an office to talk. She wants to hire one of those TV lawyers. I think that is a bad idea.

What should she do? Can she go to jail, do they actually come out and get you? I feel bad (I know I shouldn't) but she is also a substance abuser who really truly owns NOTHING and owes alot of $$ to the IRS apparently and a lot of other people.

She should find out who is looking for her or have a representative do it for her. Hiring "one of those TV lawyers" will cost her an arm for work done by a non-lawyer. She needs someone who can prepare and file her returns and deal with the collection issues after they are done.

I am an enrolled agent, a tax specialist licensed by the US Treasury Department Office of Professional Responsibility (not an IRS employees) to represent taxpayers the same way as attorneys and CPAs and specialize in clients who have substantial outstanding tax liabilities or long periods of failing to file returns for fees less than half what one of those TV lawyers is going to charge. Recently, Wesley Snipes (the movie actor) just got three years in prison and paid a $5 million dollar fine for screwing around and not paying his taxes. Does that tell you anything?

Hiring one of the TV lawyers would be a very bad idea at this point. But hiring a CPA or enrolled agent would make a lot of sense.

If you owe enough in taxes, yes, you can go to jail for tax evasion. The IRS is targeting businesses just like your friend who are working under the table. Because people like these do not pay their taxes, the people who do pay taxes end up having to pay more to make up the difference.

The IRS can investigate her finances (bank accounts, credit cards) and calculate a tax return for her. She will owe income taxes as well as self-employment taxes, plus the non-filing penalties and interest fees - That's why people end up owing so much money - their tax bill could double!

She probably should talk to someone, but don't know that one of those TV lawyers are the best deal. I would recommend talking to a tax accountant who is an EA (an enrolled agent who has been tested & credentialed by the IRS.) They should probably also be a CPA. An experienced accountant would be able to tell her if he/she can help her or if she needs the help of a lawyer. Depending on how far the case goes, an EA or CPA can help her.

It's like a bandage. The more she waits and avoids dealing with it the worse it's going to hurt with added fines and interest. What's the worst thing that could happen. Jails are overcrowded and people are being released everyday for no reason, I don't think they'll put her away long if at all. If she gets a short stay in jail at least she can get help with her sub. abuse problem.

Sounds like she is in trouble. She may have to spend time in jail and then pay the IRS anyway. If she doesn't have any money how is she going to hire an attorney?

She should go to the IRS and try to work this thing out before it really gets ugly.
