They could but this is something WAY bigger than your IRS refund. You do know that this loan will NEVER EVER go away right? Yiu can't get rid of it through bankruptcy or any other way. The company you owe this money to actually LOVES that you aren't paying on it because they are making thousands and thousands of dollars off of you the longer you don't pay it. I personnally know someone who let a $19,700 federal student loan go into default. They really thought they were getting away with things by ignoring the letters that the company would send and the phone calls, they even tried moving to get away from this debt. Well about 2 years later they wanted to buy a house and were in a better financial situation so they thought they would just go pay the almost $20k they had been ignoring. They finally called the compnay to find out how much to write the check for and they told him $128,111. That's right! Every month your loan accumulates interest, late fees and penalties all while compounding away and getting much much bigger. Are you still worried about your IRS refund? Time to get on the phone and make an arrangement with them. My friend, he is still paying on the new $100k+ money he NOW owes. Not a smart way to plan your future.

Yes and yes. They can also garnish your wages. You can no longer get rid of student loans via bankruptcy but will be required to pay no matter how long it takes.

You might be able to get a deferment but the interest will still keep racking up.

They can, and probably will, take as much of yur refund as the amount you owe including whatever interest and penalties you have accrued.

Yes, you would have probably recieved a letter regarding this! They will take it all and continue to take it every year until it is paid in full! The best thing for you to do is to get on the phone and get out of default by either working out a payment plan! If your wages are currently being garnished by the government most likely they have all the paper work done to take your taxes as well!

It really depends on how long you have been in default. You would be best to try to get it "deferred" because of financial hardship. The good thing is, if it is a large amount, they cannot take all of your tax refund (same thing with garnishing your wages) only a certain percent.
I did have part of my tax refund taken last year for an old student loan (about 200.00) but my loan was in default for like 5 years before they did that. But even if you can only pay 5.00 a month!they can't do anything then.

actually it does depend on how far in default you are with it and if you have gotten letters and all the good stuff and yeah they can and will take anything they can get to take care of that loan
