They will take the entire refund and give it to your children.
Your wife does not have to file a return, she has no income to declare, no refund, owes no income tax. You just list her as a dependent on your taxes. |

If you do not live in a community property state, ALL of it.
If you live in a community property state, file jointly and attach a form 8379, then she gets 1/2 of the refund coming from withholding and the additional child tax credit. (EIC is a federal program, so all of it would considered yours.) |

They can take out as much as you owe, even if that is the full refund. Your wife had not income so she can not do an injured spouse.

I think your just trying to get out of paying your child support responsibilities. No, your wife can't file if she has no income to report. As far as how much, depends what you owe. Good luck! |

They can take any refund you may be due.
And you file with your new wife, regardless of how much income she did or did not make. When you're married, unless you've been separated for some time, you have to file either married, filing jointly, or married, filing separately. Unless one of you has a large tax debt or a lot of medical bills, then you should probably be filing jointly. All of your income and expenses (those that are deductible, of course) are pooled, so it doesn't matter if she didn't make any money during the year.

I speak from experience in this matter......they can and will take all your refund; everything. The fact that you are married has no bearing on this procedure. So, if you are trying to have your wife file under her name, don't bother....they'll still take all you owe.
Always remember: NEVER SEND CHILD SUPPORT PAYMENTS TO THE CUSTODIAL PARENT DIRECTLY!! ALWAYS SEND THE PAYMENTS TO THE CHILD SUPPORT DIVISION, SAVE ALL RECIEPTS AND DOCUMENT DATES AND ALL OTHER INFORMATION! |

They can take everything. She can apply for injured spouse relief, however she has no income so therefore is not owed any refund. If she works this year she may be able to getinjured spouse relief next year. As long as you owe more than your refund, they can take it all until it is paid. But in the end, that is what is right. Take care of your kid/kids. Having your refund taken for child support is good for your child and yourself. It helps to get those who are behind caught up. |
