You cannot both claim him--only one person can claim a dependent. The sole exception is when a married couple files jointly, and they jointly claim the children. The child still only shows up on one tax return. Keep in mind that the IRS always audits tax returns that involve a child being claimed twice.

You can both fill out the paperwork and see how much you pay with him, and without him, and pick the best result. It's probably him, because you don't work.

It's pretty easy to test if you're using computer software to fill out your taxes. Various programs are available for free on-line if you make under a certain amount, too. Definitely use them this morning and get it done now, because the systems will be strained later on and run more slowly.

You're saying "our son". The boyfriend is the father legally, correct? Claiming a child is only possible if you are related to the child, or the child is adopted/foster/step.

For everyone is wondering what she is filing for even though she doesn't work:

You pay taxes on any income earned, which includes interest, profits from gambling, lottery or other prize winnings, and a variety of other things that can apply to someone who doesn't work. Additionally, if there is any chance of you receiving a stimulus check (general rule: you have $3000 income) you should file taxes this year even if your balance is zero. It's the only way to get your free $300.

two people cant claim the same person. if you file together than it will all be together..if not only one person gets to claim. and since you dont work you cant get the EARNED INCOME credit.....you have no earned income..

If you don't work and don't have any earned income you will not qualify for the Earned Income Tax Credit (EIC) so your boyfriend should claim your son for all benefits. If you had some earned income last year, I would work it up both ways and see which one is the most advantageous. In no case should both of you try to claim the same child. The IRS will not allow it.

If this is his biological child, your boyfriend will be claiming him. He is eligible for possibly HOH filing status, exemption, child tax credit and EIC. You get zip because you didn't work. If you lived with the boyfriend all year long and he supported you, he can even claim you as a qualifying relative.

If this is not his bio child, he must be able to claim you before he can claim the child and then he claims you both as qualifying relatives (relationship = none).

If you didn't work, what were you thinking you could file for???
