No law says you are required to claim your dependents, either for withholding purposes or when you file your taxes. You will get found out and thrown in jail for claiming more dependents than you have though.
You must report your correct marital status however. |

Yes you can...and no it's not illegal, until you file your taxes for the year...but why would you want to do this? If it is so you can get more money back at the end of the year from your tax return, consider this...open a savings account, that money you'll get interest on...you don't get interest from the IRS! Many companies have banks or credit unions that will take the money directly out of your pay at the end of the week. Look into a 401k or other account if savings doesn't suit you. Having the gov hold more money won't get you more on the earned income credit either..so, I would find a savings account, or rainy day account for medical bills..for your kids..many states have that now too. |

You can claim whatever you want on your W-4 for withholding, but that won't change your tax liability when you file your taxes. |

No, this is not illegal. In fact, there is a check box that says "Married but withhold at the single rate".
Like others have said, you'll probably end up with a big tax refund, which means you gave the government an interest free loan.
Go ahead and claim zero exemptions. After your next paycheck where your employer takes out a whopping big amount for taxes, fill out a sample tax form using just the information from that one paycheck. Figure out the yearly wages and the yearly taxes withheld, and to make this little exercise easy, just take the standard deduction (don't itemize), and see how big your refund will be.
If it's a large refund, think about who could make better use of that money during the year, you or the government?
You can always submit a new W-4 at anytime. |

It is not illegal. When you file your taxes you will get all that extra deductions back. I would file correctly, and ask my employer to take that extra money and deposit into an interest bearing savings account. That way you can always access it and it will gain the interest monies too. |

You can put anything on your w-4 that you want to. If you use single and claim zero, you'll have a slug of money withheld for taxes on each check. Some people do that on purpose so they get a bigger refund at the end of the year. |

One thing you can usually do if you want more taken out is say Married with 2 dependants and most places will let you do a plus $(you choose). I used to do S-1-+$4
I understand where you are coming from... some people prefer the extra $5 in each paycheck but a person like me has a tendancy to waste it. I like the larger refunds because I can do something with it. |

An understated W-4 form is not against the law. The employer shall take more pay out of your pay check than you would pay otherwise.
If you over state the deductions, your employer shall take less out of your pay check than you should have taken out.
You have broken the law if you file a false tax return. If the tax return is correct then the law is not broken. |

Yes, or even claim just one now. Of course there will be a much heftier amount of tax withheld, but you will get it back! It is kind of like a once a year savings account. |

It's perfectly legal to claim less exemptions than you're entitled to. That way Uncle Sam gets an interest-free loan and you don't get socked for a lot of money when you pay your income tax. You may even get a refund. On the other hand, claiming more exemptions than you're entitled to is a no, no. |
