If I file my taxes illegally, what's going to happen?
Ok, for whatever reason, my husband and I didn't have fed. taxes taken out of our checks all year. When I went to file, it said we owed over 1,000. When I took his income off, it said I would get a refund of over 4,000, because of eic. We really need this refund to move out of state, and if I file it without my husbands income, and we get the return, what will happen?

The IRS will get a copy of your husbands W2 and will send you a bill with interest and penalties added on. I recommend you file an amended return and be honest. It is cheaper in the long run. You will be disqualified from getting eic in the future.

You take a risk of being audited by the IRS.......and you will have to pay back the money with interest and penalties......and if they think you were trying to commit fraud....well that is a whole other problem.....

There is a 100% chance that they'll notice he didn't file if he has either a W-2 or a 1099. I could take a year or more before they get to chasing you for it, or could be a lot sooner, but it will happen. At that point you'll have to pay the additional tax, plus paying back whatever you got illegally by filing a false return, plus penalties and interest which could add a lot by that time.

Oh, and for fraud for EIC, you would most likely be banned for ten years from getting it even if you qualified during that time.

Prosecution and prison for deliberately filing a fraudulent return are possible but very unlikely. But messing with the IRS isn't a good idea at all.

Don't mess with filing EIC when you really don't qualify as it can block you out of getting EIC for several years!!! There is an EIC questionaire that you have to fill out. Make sure you answer every questions correctly.

You could file married filing separately, and file your taxes now, and his taxes later - but you will end up owing the $5,000 in taxes - or perhaps even more. You really don't want to get into tax trouble with the IRS.

No biggie. The federal government is really lenient on tax evaders. You should not get more than a hefty fine and some time in PRISON!

Why would you even tell people that? But since you did,you could be audited, fined on top of the original $4000, plus interest and penalties. And if the auditor is a real "witch" they might charge you with tax evasion, which could = jail time. The child/children you used to commit this fraud will be too old for you to take on your taxes by the time your eligible for eic again. This only a wrost case senario.

if you really need the extra money, you would be better off robbing a bank or something (i wouldnt really do that)

You didn't have federal taxes taken out of your checks all year long, and you just know notice? Did you think that you would not have to pay taxes? Poor planning on your part. You had the money that should have been used to pay taxes in your checks all year long, and NOW you are crying because you owe? Give me a break...If you file your taxes and do get EIC illegally, you will be eventually be found out, and you will have to pay back all that money, plus interest, plus penalties and you will be barred from getting EIC for 10 years....Is the $4000 worth all that?
