Ok me and my boyfriend have a joint account through bank of america, if we file taxes as single can I still do my direct deposit into our joint account? Or will i need a separate account with only my name on it? Additional Details I'm asking because last year, we filed married filing jointly, and we messed up and had one of those ace check card accounts and only had my boyfriends name on it and since our tax check was together, they sent it back and it took an extra 6 weeks to get our money... this year we will probably be filing separately but now have a joint bank account and I just dont want the same thing to happen.. |

If both of your names are listed on the joint account, then the deposit can be made into the account. The IRS will not allow a deposit into an account that you are not an owner of. This is a very good safety measure that keeps errors from happening.

Yes it will deposit as long as your name on the account and the refund match. My husband and I do, and it goes through fine, It is like the direct deposit of your payroll check, and it's your name only on the check. Hope this helps. |

Your name has to be on whatever account you are trying to deposit it into. They dont care if it's a joint account, as long as your name is on it. And yes, they check to make sure your name is on it as it illegal to deposit a refund check into a bank account that belongs solely to someone else. Check out the IRS website. Also if you are not LEGALLY married you can not file as anything other than single or head of household. |

I would have two seperate accounts, in case they have soft ware preventing non married persons using the same account to prevent fraud. So to be safer and know your not wasting time waiting, get a second account, you can simply close it once the money comes in. Your only choice is single for tax status. |

If your name is on the account, there shouldn't be a problem depositing your refund.
But about the married filing jointly. If you have followed the Texas rules for a common law marriage, then you are married and can't file as single this year unless you have gotten a legal divorce in the meantime. You can't just switch back and forth at will. If you filed joint last year based on a common law marriage, and file single this year, unless you got a legal divorce in the meantime one of the filings was illegal.
