If I moved in with my boyfriend, do we pay taxes differently?
I moved in with my boyfriend in June 2007. He works and all that and I worked up until November 2007 (damn you company I shall not name) I have a child and I claimed her this year. Do we have to file together even though we are 1) not married and 2) he doesn't claim me OR my daughter as a dependent. You only can file together for federal taxes unless you are "legally" married. http://www.irs.gov/publications/p501/ar02.html#d0e1150 under "Marital Status"

Okay, here is what the IRS says about head of household status:

"Generally, to qualify for head of household status, you must be unmarried and you must have paid more than half the cost of
maintaining as your home a household that was the main home for a qualifying person for more than half the year. " http://www.irs.gov/taxtopics/tc353.html So,

I looked up Qualifying Person

Scroll down or search for "Table 4" The categories for Qualifying Person (to allow your man to file head of household), all three of the minimum characteristics require that the person in question be a "relative" In fact looking more, Example 4 in Qualifying Person section specifically relates to a girlfriend's child *not* being a qualified person.

So :( From what I see, he can't file as head of household, this year anyway... :)

No, you CAN'T file a joint return, since you are not married. File just like you always did. And no, he is not head of household for tax purposes - that requires among other things a closely related dependent, and he doesn't have one unless your daughter is his biological daughter and he claims her. If she's your child but not his, then no he can't. And unless you are providing over half of the cost of maintaining the household, which seems unlikely if he is making so much more than you are, then you can't file as head of household either.

Yeah you both aren't married. Just live in girlfriend and boyfriend. Hell some married couples file separately. You do your taxes the way you did before you lived together.

You file separately if you're not married, but if he is your child's father and supports her he can claim her. He's also
head of household. I'm not an expert but something similar
happened to me . (I let the wife deal with it)

If you lived with your boyfriend and your not married obviously, then you each file your own seperate taxes.

If you claim your child, then you file as head of household and claim your child as a dependent.

He files his own as single.

The only way he could claim you is if you had less than $3,300 in income and even then he wouldn't be able to claim head of household, he'd file single with you as a dependent.

In that case if he claims you, he can also claim your child if he's providing support. But he couldn't get head of household then either, because the child is yours not his, so there's no qualifying relative. He couldn't take EIC because you and your childs father are able to do so whether or not you exercise the option.
