Tracy P | If I owe back taxes will the IRS keep my stimulus refund? |
|
|

The IRS has made it clear on their website that offsets are to be treated for the stimulus rebates the same as refunds are treated.
If you owe back federal or state taxes, they'll deduct it from your rebate. The same is true for child support in default and student loans in default.
That info is right on the IRS website. Here's an exact quote from the FAQ page for the stimulus rebate:
"Your payment may be less than the maximum for one or more of the following reasons:
You are single and your net income tax liability is less than $600. If you file Form 1040 net income tax liability is the amount shown on Line 57, plus the amount on Line 52.
You are married and your net income tax liability is less than $1,200.
You are single and your adjusted gross income (AGI) is more than $75,000. On Form 1040, AGI is the amount on Line 37.
You are married filing a joint return and your AGI is more than $150,000.
You owe back taxes. ****
You have non-tax federal debts such as unpaid student loans or child-support obligations." |

I am not sure about everyones answers here. When it first was out on the news it was called a "rebate" not a refund and it said everyone would get one regardless whether they owed taxes or not ! I would just wait and see, alot of people are speculating about this topic ! I have done my research.... |

If you owe back Federal taxes of any type or State income taxes then your refunds and any rebate will be applied against your tax debt. If you owe LOCAL taxes or State taxes other than income taxes then your refunds and rebate are safe from capture. |

Ms. Angel..

Of course IRS will keep their money, which is a good thing because you will be available to lower the amount you owe. |

Probably. They can, at the least. Whether they will or not is up to them. |

No, as long as you file your return for 2007, they have to mail your check to you. If you owe for 2007, they still have to send the check. |
