Since you did not live in the house for two of the last five years, you cannot exclude any "profit" from the taxman.

The way you figure it, the house sale is a "short term capital gain," which goes on Sch-D. How much of the profit (not the selling price) of it you pay to the federal is somewhere between 0% and 35%, depending on your other income.

I don't know the tax schedules for NJ.

Figure since you did not live in the house for 2 years, you cannot exclude the gain.

You would pay as short term capital gains and your rate would depend on what your other income .

depends in your tax bracket, and if you sold another house within 2 years. If you plan on purchasing another house as investment check into 1031 exchange programs

check out capital gains for specific details.

As others said, your tax bracket and other factors will determine the percentage of tax on the profits. Note also that the "profit" does not include any improvements you made (increase in "basis") and there may be other amounts from the purchase transaction (certain closing costs) that can be deducted to reduce the amount of taxable "profit".

Tax laws have changed, now you can deduct up to $500k in profits when selling a primary residence. Check with your tax adviser.
