If you sell the occasional item of personal property for less than you paid for it there is no tax owed on the sale. If you sell it for more than you paid for it, capital gains taxes are due on it.

If you're in the business of reselling things on eBay for a profit then you must include this in your income and pay the taxes, including self-employment taxes, on the income you earned.

BTW, the IRS LOVES to find businesses masquerading as "garage sales" and they put any number of them out of business every year. Don't forget that IRS agents go to garage sales and buy stuff off of eBay just like everyone else does. Once you get on thier radar screen, you're busted.

You only need to report a capital gain - if you sold the item for more than you paid for it.

It depends, and the answer is the same for ebay as for garage sales. If you are just selling your old stuff, you are most likely selling it for less than you paid for it originally, so you don't have a profit - so you don't claim it or pay tax on it. If you make a profit, then yes you are required to claim it.

Yes, it is still income to you. Most folks won't bother reporting and the IRS will not follow up on tiny amounts. However, the E-bay sales are a matter of record and can be traced. Best to be upfront about it.

If you sell items for more than your paid for them, you pay tax on the difference. This applies even to garage sales.

However, if you are selling items that you purchased new, you will probably receive less than you paid for them. If this is the case, then you do not have to pay tax on the income.

It's a gray area. What I've been told is that if you sell the item for less than you paid for it, you're not making a profit and therefore you don't have to report it. I'd check with a tax professional to make sure, though.
