Taxes are due the year the commission was earned and payed.

Constructive receipt is in 2008 so that is when it is taxable. You can hold onto ithe check for five years and it won't change a thing.

Taxes are based on income earned in the year.... not when you got around to depositing it...

You pay taxes and report the income in the year it was earned. The company paying out the commission will undoubtedly report it in the year it was issued also on their return so you definitely don't want to try not claiming it in the year you receive the check.

The date you deposit is not the important date. The important date
is the date the check is issued. You are taxed on the date the check is available to you. If your get the check on Thursday night but it is date Friday, it is taxable on Friday even if you don't put it in the bank till a week later.

depends on where your employer claims it - it's probably going to be be in your 2008 1099 or w-2

IF you want to include it in 2009 income instead of 2008, talk to whoever is paying you the commission. Ask them if they can delay paying you the commission until after Jan 1, 2009, then you can include it in 2009 taxes.

But if you receive the check in 2008, you have to declare it as 2008 income and pay tax on it in 2008 even if you don't actually cash the check until 2009.

For personal income tax purposes, income is considered to be earned when you receive payment, not when you cash the check.

If you receive the check before 12/31/2008 then it is credited to tax year 2008; even if you don't deposit same until January. This is straight from IRS rules and regulations; probably a good idea anyway as the wise ones in washington are going to slap us with higher taxes in 09 to pay for the bailouts and yada. Get it in for 2008 when our rates are still low and reasonable.
