If IRS owes me money can I still file taxes late without filling for extension?
I changed my marital status in FY 2007, but my wife is not in US and she will be coming to US in July. I wanted to know if I can file taxes later in the year (say in July) without actually asking for extension/filing for extension before Apr 15?

You are still legally required to file by 4/15 if you have enough income to have to file, but if you are owed a refund, there isn't any penalty for missing the deadline.

But why don't you just ask for an extension?

File now. She does not need to be in the U.S. to file. All she needs is access to either a computer (to file online) or a pen and a mailbox (to file a paper return).

In theory, there is no penalty if the IRS owes you. However, you might be wrong in your belief that the IRS owes you. Therefore, it is best to file for the extension, in order to avoid any possible penalty.

Spouse away from home. If your spouse is away from home, you should prepare the return, sign it, and send it to your spouse to sign so that it can be filed on time.
