If i am sacked due to illness will i be able claim benefits?
due to illness i have had alot of time off.my work have told me either to leave or be sacked.my doctor has advised me to leave. but i have just been told if i leave i cant claim benfits if i am sacked i can.but then surely if in the future i am better and want to work again wouldnt this make it harder?
does anyone know anything about this and what i can do for the best?

ive been intouch with CAB and have been told as long as i have doctors backing and he gives me sick notes then i can claim benefits straight away as it is due to ill health

i have found my usual site for you re benefits and employers.
there are 2 links i have provided for you. the last 1 will help you on what you can claim ect.

You should be aware that you can still be dismissed if you are off sick.

Your employer would normally be expected to allow a reasonable amount of time for you to recover from your illness. The actual amount will depend on things like:

how long it will take to recover
how certain it is that you will recover (with some illnesses, like broken bones, it is clear how long it will take but with something like stress it can be uncertain)
how easy it is to get cover
whether your job can be kept open

Firstly, if you are sacked for being ill, your employer has breached employment law and can be taken to an Industrial Tribunal for unfair dismissal.
Your Dr should be supporting you by writing a medical report on your health and your employer should take note of it and offer you alternative working conditions and duties.
If you are a union member, see your steward, if not, you need the Citizens Advice Bureau.

you are not entitled to benefits if you leave or are sacked for a period of time,there are loop holes,got any doley mates that know the system,you'll get your rent and council tax paid but not a lot else,you may be able to claim job seekers allowance

Hi,if your employer says your job needs to be covered then your employer can dismiss you.I worked at BASF cleaning I was dismissed on these grounds I am married so it did not affect me.I would listen to your doctor & in the future if you decide to get a job you can tell your employer that you thought it was unfair to your previous so you let them sack you so they could find some one else & you would carry on getting benifits.Good Luck
PS/ You could always contact the DHSS & let them know your situation make sure they put it in writing.

a - you cannot be sacked for time off through illness, it is illegal

b - if you leave a job then you will be suspended from unemployment benefit for 26 weeks, however.....

c - if you are sacked from your job then you are STILL suspended from unemployment benefit for 26 weeks.

that doesnt stop you claiming income support, if you qualify. or incapacity benefit if long term sick. only way to NOT be suspended from unemployment is if you are made redundant, unless you were a director then it is your fault you were made redundant so they suspend you "because they can"

I use to deal with medical reports as a job. It is complicated.

If you were to ill to work i.e
Couldn't get out of bed coz of pain,
couldn't walk,
was admitted to hospital due to illness
cancer
or broken limb
etc

For these you have to have a full medical report and will be able to claim benefits and won't be any trouble if you are then better to go back to work.

But if you aren't under any of the above you need to go to your doctor get a full medical get a report off him/her and then go to the hospital and get a second opinion as the will help you to get benefits.

You should also go to a solicitor about you being sacked as you could sue them for unfair dismissal(you should;d still be able to get benefits as well)

they cannot sack you for being ill and submitting the appropiate medical certificates from your doctor. they can suggest finishing you on medical grounds, but would have to give you compensation for doing so. you should talk to a union representative if you have one, or contact "A C A S". they are very good and will give you all the help and advice you need, dont give in to there request without taking strong advice. you dont say what work you do, but if its a heavy demanding job, they have to offer another position, if one is available. i know i have been in the same situation, and acas helped me.
