Thats Life | If i filed taxes but the person who prepares didn't send them in what do i do? |
2007-2008 i filed taxes and i did what i was supposed to do but the person who did the filing to the i.r.s did not send last years and this years forms some irs guy showed up at my house..any advice helps should i call an attorney? |

The short answer, file your taxes.
If the IRS guy is at your home, just hand them to him. Couldn't be simpler.
I guess he has already left. Mail them or fax them to the address/number he gave you. Since you already have them, do it now.
Make sure they're signed.
An attorney will charge mucho bucks and tell you to do the same.
Note: if you owe, you might ask the IRS guy for a penalty abatement, based on "bookkeeper error." The request has to be in writing. Who knows, you might even get it. |

It's YOUR responsibility to ensure that they are mailed off. Why did you not do so?
I've been doing taxes for 40 years and never once have I mailed off a client's tax return. I give them the completed returns, show them where to sign, give them an envelope to mail it in, and send them on their way. And it I'm e-filing the return, I get their signature on my office copy, print out a copy for them to keep for their records, and provide a copy of the DCN transaction once it's accepted by the IRS. |

I think you left a few things out of your question. If you are required to file but don't, the IRS sends you a letter, they don't show up in person at your house.
That said, if your return wasn't sent in, they you did NOT file a return. Have you asked your preparer why they weren't sent? If you owed money, the preparer might have given you the forms to mail with a check. |

The IRS would not send anyone to your house for this matter. If you didn't file - and it seems like you didn't - go ahead and file as soon as possible. You can still get a refund if your return is less than three years late. If you owe, you will be hit with penalties and interest, but probably not as much as you are imagining. |

So, from the IRS point of view, you never filed.
What will it take to get the tax returns filed? Hint, you generally do not want the IRS to do it. If you normally file married, with kids, itemize or have a business with lots of deductions, the IRS will make you single, no kids, standard deduction, no deductions. |

No one except you are responsible for sending your taxes out. If it was current year taxes and if you signed the proper e-file forms, then you have an issue. But if it was back years, YOU were the person that was supposed to mail the returns. Did you?

If you paid your CPA or tax advisor to file them and they didn't, I'd call and demand that money back.
Not much you can do if they weren't filed, you're stuck with back penalties and interest if you owed. If you were due a refund, you're not going to get it.
Didn't it seem weird that you either never had your check cashed for your payment or you never got your refund? And more importantly, did you watch the news this spring? Everyone filing a return got a stimulus check- you weren't wondering where yours was?? |
