If he owes back child support (from BEFORE your marriage), you can protect your part of your joint refund by filing a Form 8379 (Injured Spouse Claim). With this attached to your return, your share of the refund will still come to you. His share of the refund will go to pay his back child support.

This form will not protect you from any new debts that date from AFTER you become married.

If you file a joint return, your refund will be taken unless you file an injured spouse form with the return. If you do, only his share of the refund will be taken.

You and your husband will get your tax refund assuming you file jointly. Are you talking about overdue child support that he owes?

you can still file jointly with him but to avoid your part of the refund from being taken you'd need to file a injured spouse claim form with your return and that takes 8-11 weeks to be processed but it's best to file jointly because you pay less taxes than if you file married seperately.
