If you got your loan through FAFSA, they can just garnish your wages. If this is the loan you received, call them and discuss your options. If you filed jointly, and it's your loan that is in default, chances are this would be a last resort option for them to dip into your tax return. I am assuming you deducted the interest being paid on the loan? If you deducted the interest, when the loan was in default, it might cause FAFSA to attempt to get that refund. Depending on how long your loan has been in default would be another factor. Regardless, call FAFSA and ask for a "hardship deferral", to give you more time, and let them know you want to pay SOMETHING on it, however minimal. This is very important that you do this, because it will very negatively affect your credit. Your defaulted loan should only show up on your credit report, assuming your husband didn't cosign that loan. |

Wow. School loans have some of the best terms of any loan. AND, they are unsecured.
If you cannot pay your school loans enough to stay out of default, then heaven help you. It's clear you didn't get the value you expected from your education.
So, the bank will pursue your income. If you hold a job, they will require your employer to pay some of each paycheck to the bank. What a hassle for your employer! Your boss will probably look for a way to be done with you.
The bank might also file with the IRS to snag refunds as well.
So, I suggest you sit down with your husband and have a serious financial discussion. You two must work out a plan to deal with the debt you dragged into your marriage. And because you are now wed, it is a team effort.
You must deal with this to preserve your credit rating, so that you and your husband can hope to own a home some day.
Good news is you are not alone in this--your hubby will be by your side. Play your cards right and you won't end up alone after this mess is fixed. |

The paperwork might or might not catch up with your rebate check if you just went into default.
They can garnish YOUR wages but not your husband's. They can take your joint refund unless he files an injured spouse form each year. |

I actually know a married couple, and they filed joint and they were shocked when they didnt get the 1800 they were supposed to, it was 600 short. They found out when going to a local office that 600 of back student loans from the husaband from over adecade ago were garnished out, so I;d not count on getting the full amount you think you are. |

Yes they will take your refunds and stimulus from Joint return; your husband married you and your debt. Your stimulus more than likely has been offset to your balance.
Contact 1-866-234-2942 to verify your rebate has been either sent to you or offset.
Any and all future refunds will be offset.
Why don't you call phone number listed on your letter from the school loan and request again to make your own payment instead of having your wages garnished. But just don't default this time. |

Not unless you're 180 days or more past due. Try to call your loan place and work out an arrangement through deferrment or forebearance to get yourself current. |

Judy is correct, they can take your husband's rebate, unless he files an injured spouse form, in which case his half will be released. More to the point, why are you in default? Student loans do not go away - pretty much ever. You should look into a hardship forbearance. Defaulting on student loans will keep haunting you. |
