If my 16 yr old files her own return, can she still be claimed as a dependant?
My daughter worked part time and will have income to file, I did not work, I am disabled with no income. Can my boyfriend claim my 2 children and me on his return as dependants because he helped support us even though my daughter will file her own return and maybe get her own refund back based on the taxes she paid in?
I'm not sure if your boyfriend can claim you all but I know that if you worked then you could still claim your daughter, my mom claims me still.

I believe your boyfriend files head of household and can claim all of you. There will be a spot on her taxes to mark if she can be claimed by someone as a dependent so make sure she files it right since you are still a responsible party for her.

you should consult the IRS website to answer some of these questions.
but it it my understanding that you two would have to be legally married to have him claim you.
as for the children, without the marriage, he would have had to be the kids legal guardian for the reported tax period.

Yes, you can claim her. On her tax form there will be a question asking, "Can anyone else claim you on their taxes," or something like that. Have her check yes, and your boyfriend can claim her.
?
Your boyfriend can claim your children as qualifying relatives if the following conditions are met.
1) your daughters did not make over $3,400 each last year
2) they lived with him the entire year
3) they cannot be claimed as dependent children on anyone else's tax return
4) he provided more than 50% of their support.
If these conditions are met, he can claim them on his returns. He can also claim you if the same applies to you. If the daughter that worked isn't qualified (such as she made over $3,400.00), but your other daughter is qualified, he can claim just her.

YES YES YES and when she's in school at college and when she gets married and still lives with you IF she is your dependent then she is your dependent. Even if you didn't work, she is still your legal dependent. As a dependent SHE MUST FILE AS A DEPENDENT.
Your boyfriend MAY OR MAY NOT be able to claim you and your children. For you being deducted the answer is Probably IF you file a joint return. In the case of your children MAYBE IF no one else is claiming them such as your former spouse or depending on your devorce papers.
