If my ex husband hasn't paid child support since March of 2007 does he still get to claim her on his taxes?
He hasn't paid since March of 2007, but in my divorce decree it says he gets to claim her, but the IRS says whoever pays 51% of her support gets to claim her? Which one do I have to go by? If he hasn't paid -that isn't fair!

Your divorce decree is the loophole that allows non-residentaial parents to claim their children without the child actually living with them, or without them paying 51% of the support of the child. You follow the divorce decree. It fits under the IRS rules of children of divorced or seperated parents.

Now it should also say in the divorce decree that his support has to be current or paid in full or something like that, in order for him to claim the child. So long as it says something like that, If he does not have his support paid for 2007, then he can't claim the child, and he's lost his turn. Most divorces put this clause in there to give the paying parent an incentive to not get behind. But you need to check your divorce papers one more time. If it says he has to have his support current, and he doesn't, then you can claim the child instead. If your papers don't say anything about his support being current in order to claim the child (which I would consider odd) then you can't claim the child, it is his year, legally.

Check those papers carefully.

You could get away with claiming her because he'd be hard pressed to go waving the court document at the IRS. You need to get child support enforcement services to collect the support ... and their first step can be to seize any tax refund he is due! So, ignore the court doc for now, and just claim her. The IRS can sort it out, and they will come down on your side one way or another! Good luck!

The court papers determine who gets to claim your daughter. If he isn't paying child support, then you need to file a complaint with the attorney general. If you file a complaint and he gets an income tax refund, the attorney general will grab it for you.

yes he can you need a court order in place to not allow him to claim her on his taxes he would never paid a dime he can still claim her until you get a court ordering him not to do so

You're right, it isn't fair. I can't advocate to go against your divorce decree, but I would go back to family court to have that changed.

The IRS says whoever pays most of the support gets to claim her *UNLESS* the divorce decree says otherwise.

You can (and should) pursue the back child support through other legal means, but you can't legally stop him from claiming her on his taxes unless you go back to court and get the decree rewritten.

Typically the person who is the managing conservator, the person who the child lives with is recognized as the person who provides the majority of the support and should be able to claim the child on their taxes. Call a good family law lawyer and get the answer and while your at it, deal with why he hasn't paid support since March of 07. You have recourse, use it.
