are you both obligated to pay the support, or just him?
if so why not amend and file an injured spouse form, the IRS will allocate what would have been refunded to you..(your the injured spouse)... doing the amendment will also allow you to get ½ of the stimulus money as well....

also go and amend the last 3 yrs with that form as well...

As others have said, if your tax return was taken because of child support, so will your tax refund check.

I hate to be the bare of bad News , BUT No my hubby and I have the same issue. However what you can do is file your own return. this way it will allow you to get back what you have paid in. If you have children you and claim them and get the EIC.

It depends on how much is owed in back child support. If the amount owed is equal to or more than the refund you are expecting, you can count on recieving nothing but a letter from the IRS stating how much was owed, deducted and dispersed. In any case you will get a letter before you recieve anything.

Hi, for next year (to save yourselves!) get him to redo his withholdings form (asap) at work so they don't take any more out! That way he won't get screwed again. I think everyone should be able to keep their paychecks. Everybody else is partially correct though, unfortunately IF he owes any more (which he may not, I'm not aware of your situation) they will take out as much as he still owes. HOWEVER, just because they took last year's doesn't mean that they will keep this one if what he owed was taken care of by them taking it all last year- OR that you won't get the tax break. You will absolutely still get the tax break, whether or not they suck it up before you get it depends on how much your hubby still owes. Sorry for the confusing explanation dear. Good luck with this

Did you file taxes? Then yes.

Whether or not you received it is irrelevant. The rebate is basically an advance on your 2008 taxes.
