If my mom claims me on her taxes and i file for myself and my two kids do i get more or less?
i usally file for myself but hard times have had me here for over half a year and my mom and i are wondering how we should do it this year

Did you work this year? How old are you? Really, I don't see why your mom should claim you unless you didn't work- then you should let her claim you and the kids. You dont have to claim yourself on a return

There's quite a bit of BAD advice going on here from people who simply do not know the law. There are so many errors in most of the other posts that I won't waste my time correcting them. Here is the correct answer:

If your mother claims you as a dependent you may NOT claim any dependents yourself.

If your children lived with her for more than 6 months she can claim your kids as long as your kids did not provide more than half of their own support.

Whether or not she can claim you will depend upon your age, student status, and your gross income.

If you're under age 19 or under age 23 and a full time student she can claim you as long as you lived with her for more than 6 months and did not provide more than half of your own support.

If you are over the age limits then she can only claim you if you lived with her ALL year and you had less than $3,400 in gross income for the year AND she provided more than half of your support.

I am going to assume you all live together.

If your mother claims you, or is allowed to claim you, then you cannot claim a dependent. In this case, your mother may as well claim you as well as your children.

If your mother cannot claim you, she could still claim your children, or you could claim your children. It is your decision. So if this applies, have your tax returns done with and without the children on each return (or, you can each have one child on each return) and see which way provides you with the greatest benefit.

If your mom can claim you as a dependent, then you can't claim your kids - a dependent can't claim any dependents. Your mom might be able to claim them too, though.

Unless your mother has paid more than half of your living expenses, and you will not be filing your own taxes because you had too little or no income, there is no way you mother can claim you or your children. You would probably make out better just filing your own to prevent your mother from getting into trouble.

If you claim yourself and the two children and your mother claims you there is a little case of fraud going on. If you are caught and you have certified that the tax return is accurate you may face a stiff fine, perhaps a term in the pokey, and if I knew who you were, bet your booties you would be reported. Then see how hard times would be. So play it honest and then you can both sleep nights.

the IRS allows 3,400 deduction for each child. So if you file for yourself and two kids you should be able to deduct 6,800 plus any other itemized deductions you may have. I hope you saved your doctor's receipts for this kiddos this year. You can claim up any medical expenses that exceed 7.5% of your income. If you are of age to have two kids, you need to be filing for yourself.

If your mom claims you and then you turn arround and file yourself you are going to get audit u cannot file the same social security number twice either you file yourself and the kids or she file you but if you file you will get more because you have kids and your mother wont get that much from you because you are older

Squeakers
Your mom can't claim you on her taxes if you are filing your own taxes. You will end up getting in trouble with the government, and maybe lose even more money in taking a risk like that.
